A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING GENERAL PLAN AMENDMENT AND ZONE CHANGE
(GPA/ZC 8g-04C)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, Mr. William Netolicky, et. al., has filed an application requesting
a modification of land use designation and zone classification for Assessor's
parcels 314-350-07, 22, 34, 36, 37, 38, and 39 consisting of approximately 5.73
gross acres and located at the southwest corner of the intersection of Pomerado
Road and Icarus Lane; and
WHEREAS, the application requests a change in land use and zoning from RS-3,
Residential Single Family-3 (3-4 du/net acres) to RSC, Residential Senior
Citizen {12-25 du/net acre}; and
WHEREAS, the City of Poway held a properly notice public hearing in accor-
dance with the California Government Code and the California Environmental
Quality Act to consider that request; and
WHEREAS, the City Council has considered the information presented in the
staff report on the proposed application and hereby determines that the current
land use is appropriate, and the Council does not wish to consider redesigna-
tion.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny,
without prejudice, proposed General Plan Amendment/Zone Change 89-04C.
