A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
DECLARING A PUBLIC NUISANCE TO EXIST
ON PROPERTY IDENTIFIED AS
ASSESSOR'S PARCEL NUMBER 321-180-58 (VAHIDI)
WHEREAS, the officials of the City of Poway have inspected and found that
the property identified as Assessor's Parcel Number 321-180-58 contains a public
nuisance including rubbish, debris, refuse, equipment and machinery; and
WHEREAS, an appeal to the City Council from the City Manager's decision to
abate dated September 26, 1988, was not filed within a timely manner, in
accordance with Poway Municipal Code Section 8.72.030{D); and
WHEREAS, the City Council heard the appeal on September 5, 1989, and
concurred with the staff's findings; and
WHEREAS, a Notice of Intent to Lien has been filed with the San Diego County
Recorder.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway as
follows:
Section 1: The City Council finds that the violations identified by the
City's Code Compliance Officer during the inspection of the property on
January 6, 1987, including rubbish, debris, refuse, equipment and machinery,
constitutes a public nuisance.
Section 2: The City Council finds that the City Manager's decision dated
September 26, 1988, is appropriate. Said decision granted six months to the
property owners to make the equipment operational. Absent that, the
property was to be cleaned and costs assessed to the property owners.
Section 3: The City Council finds that the appeal from the City Manager's
decision was not filed in timely manner.
