A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AUTHORIZING THE DEPARTMENT OF SAFETY SERVICES
TO CHARGE FOR THE RECOVERY OF COSTS
PURSUANT TO CALIFORNIA CODE SECTIONS 53150 THROUGH 53158
WHEREAS, Sections 53150 et seq of the California Government Code allows
public agencies to recover reasonable costs from persons who, under the
influence of alcohol or drugs, or through wrongful conduct, causes an accident
requiring an emergency response; and
WHEREAS, such liability shall not exceed $1,000 for a particular incident.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway as
follows:
That the Department of Safety Services is hereby authorized to recover the
costs associated with emergency services responding to an incident which was
caused by a person operating a motor vehicle under the influence of alcohol
and/or drugs, or through wrongful conduct, as set forth in Government Code
Section 53150 et seq.
PASSED, ADOPTED AND APPROVED, by the Ci~'~Council of the City of Poway,
California, at a regular meeting thereof this~O~h day of October, 1989.
