A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ESTABLISHING STANDARDS FOR THE ISSUANCE
OF SEWER CAPACITY FROM THE "REDEVELOPMENT PROJECTS" CATEGORY
PURSUANT TO ORDINANCE NO. 304
WHEREAS, by Ordinance No. 304 the City Council of the City of Poway has
established a plan of allocation for the remaining 884 units of sewage capacity;
and
WHEREAS, Section 2 of said Ordinance allocates 573 units to the category
entitled "Redevelopment Projects"; and
WHEREAS, Section 8 of said Ordinance requires that the City Council
establish by resolution standards to guide the issuance of capacity from the
"Redevelopment Projects" category which will maximize the public benefit derived
from the use of such capacity and enable the Agency to meet its legal
obligations.
NOW, THEREFORE, the City Council of the City of Poway does resolve as
follows:
Section 1. Obligation to Provide Capacity.
The City Council shall be under no obligation to provide sewer capacity to
any Redevelopment Project except a project required for the Agency to meet its
mandatory legal obligations. Preference shall be given to projects according to
the public benefit to be derived from a project. Public benefit shall include
one or more of the following:
a. Provision of low and moderate income housing.
b. Development within the South Poway Planned Community.
c. Elimination of traffic circulation and flood control deficiencies.
d. Mitigation or elimination of conditions of economic deficiencies
where tax receipts are inadequate for the costs of public services ren-
dered.
e. Provision of public improvements and facilities which address
deficiencies affecting other developed properties within the project
area.
f. Elimination of blighted properties, structures, and conditions.
g. Assistance to the Agency in meeting its financial obligations.
h. Assistance to the Agency meeting the goals of the adopted
Redevelopment Plan.

Section 2. Amendment of Standards.
The standards for issuance of sewer capacity to "Redevelopment Projects"
established by this Resolution shall be modified only by the formal adoption by
the City Council of a resolution rescinding or amending this Resolution.
Section 3. Effective Date.
This Resolution shall take effect on the effective date of
Ordinance No. 304.

California, at a regular meeting thereof this 28th day of November, 1989.
