A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ACCEPTING THE DEDICATION OF CERTAIN
ONE-FOOT WIDE STRIPS OF LAND LYING WITHIN COUNTY OF SAN DIEGO
TRACT 3503-2 MAP NO. 9256 AND ORDERING THE VACATION OF THE
ABUTTER'S RIGHTS OF ACCESS RELINQUISHED AND WAIVED
IN AND TO MORNINGSIDE DRIVE PER MAP NO. 9256
WHEREAS, on County of San Diego Tract 3503-2 recorded June 20, 1979, as Map
No. 9256 in the office of the County Recorder, there is offered for dedication
for public street purposes a certain one-foot wide strip at the end of
Morningside Drive, formerly Atengo Drive, and
WHEREAS, on said Map No. 9256, the County of San Diego rejected the offer of
dedication on said one-foot wide strip as hereinafter more particularly
described, and
WHEREAS, because of the approval and impending recordation of the final map
of City of Poway Tract No. 88-05, it is in the best interest of the City of
Poway that said one-foot wide strip be now accepted for public use for street
purposes, and
WHEREAS, on County of San Diego Tract 3503-2, recorded in the Office of the
County recorder as Map No. 9256, there were relinquished and waived abutter's
rights of access from Lots 81 and 82 in and to Morningside Drive, formerly
Atengo Drive, and
WHEREAS, because of the approval and impending recordation of the final map
of City of Poway Tract No. 88-05, there is no longer any reasons for those
relinquished and waived abutteK's rights of access to remain.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. The City of Poway hereby rescinds the rejection of said strip, and does
hereby accept for public use for street purposes the following:
a. Those portions of Lots 81 and 82 designated as "portion of Lots 81
and 82 reserved for future street" on County of San Diego Tract 3503-2,
recorded June 2D, 1979 as Map No. 9256 in the Office of the County
Recorder of San Diego County, California.

The City Council hereby finds the previously relinquished and waived
abutter's rights of access across said Lots 81 and 82 in and to
Morningside Drive are hereby vacated.

The City Clerk of the City of Poway is authorized and directed to cause
a certified copy of this resolution to be recorded in the Office of the
Recorder of San Diego County.
