A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
RESCINDING RESOLUTION NO. 85-019 PERTAINING TO
MINOR DEVELOPMENT REVIEW APPLICATIONS
WITHIN THE HILLSIDE/RIDGELINE OVERLAY AREA
WHEREAS, on April 2, 1985, the City Council approved Resolution No. 85-019,
which required all Minor Development Review Applications (MDRA) for properties lying
within prominent hilltops and ridgelines be included as items for City Council review;
and
WHEREAS, on December 18, 2012, the City Council considered a memorandum
from Deputy Mayor John Mullin and discussed a proposal to eliminate the requirement
for City Council approval of MDRAs in the Hillside/Ridgeline Overlay Area; and
WHEREAS, eliminating City Council action on MDRAs in the Hillside/Ridgeline
Overlay Area will streamline the development review process by reducing costs and
processing time, while maintaining City oversight; and
WHEREAS, rescission of Resolution No. 85-019 was scheduled for the January
15, 2013 meeting but was continued to February 5, 2013; and
WHEREAS, on February 5, 2013, the City Council of the City of Poway
conducted a public meeting to consider rescinding Resolution No. 85-019, thereby
eliminating the requirement for City Council action on MDRAs within the
Hillside/Ridgeline Overlay Area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: This item is not subject to the California Environmental Quality Act
(CEQA).
Section 2: Resolution No. 85-019, entitled, "A Resolution of the City Council of the
City of Poway, California, Requiring Minor Development Review Approval by the City
Council," is hereby rescinded and no longer in effect.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 5th day of February 2013.
