RESOLUTION NO. P-13-04
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AUTHORIZING SUBMITTAL OF THE
DRAFT HOUSING ELEMENT UPDATE (2013-2020)
WHEREAS, State law requires that cities periodically update the Housing
Element of the General Plan; and
WHEREAS, California Government Code Section 65350, et. seq., describes the
procedures for amending the General Plan; and
WHEREAS, the Draft City of Poway Housing Element Update (2013-2020) has
been prepared pursuant to Article 10.6, Sections 65580-65589.9 of the California
Government Code; and
WHEREAS, the Housing Element is subject to detailed statutory requirements
and mandatory review by the California Department of Housing and Community
Development (HCD); and
WHEREAS, the City has held community workshops on the Housing Element
Update on September 25, 2012, and November 13, 2012, to solicit public comment and
has also notified community and special interest groups serving affordable housing and
special needs populations about the public workshops that have been conducted
throughout the process; and
WHEREAS, a Draft City of Poway Housing Element Update (2013-2020) has
been prepared for submittal to the HCD for review and comment; and
WHEREAS, on February 5, 2013, the City Council held a duly advertised public
meeting on the above-referenced items; and
WHEREAS, the City Council has reviewed the Draft Housing Element Update
and has considered any evidence presented at the public meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: Adoption of a resolution authorizing submittal of the Draft Housing
Element Update to HCD for review and comment is not a project under CEQA. Prior to
adoption of the Housing Element Update, an Initial Study, Environmental Checklist and
Negative Declaration will be prepared in accordance with the California Environmental
Quality Act (CEQA).
Section 2: The City Council hereby authorizes the submittal of the Draft City of
Poway Housing Element Update (2013-2020) dated February 2013, as incorporated
herein by this reference, to HCD for review and comment.
