A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
RESTRICTING USE OF THE POWAY CENTER
FOR THE PERFORMING ARTS DURING TIMES
AT WHICH ALCOHOLIC BEVERAGES ARE
BEING CONSUMED AND RESCINDING
RESOLUTION 90-008
WHEREAS, the City of Poway is a general law city with a
population of less than 50,000 persons; and
WHEREAS, the real property upon which the Poway Center for the
Performing Arts has been constructed is surplus school property
leased to the City of Poway by the Poway Unified School District;
and
WHEREAS, the Poway Center for the Performing Arts is to be
used for Community Center purposes and
WHEREAS, the City of Poway wishes to restrict the use of the
Poway Center for the Performing Arts by prohibiting the sale or
consumption of alcoholic beverages during certain events and
activities.
NOW, THEREFORE, the City Council of the City of Poway does
hereby resolve as follows:
Section 1: Declaration of Intent. The City Council of the
City of Poway does hereby declare that the Foundation for the
Performing Arts, a nonprofit public benefit corporation, intends to
obtain a permit for the sale of alcoholic beverages at the Poway
Center for the Performing Arts pursuant to Business and Professions
Code Section 25608(b) and that it shall be the official policy of
the City of Poway to comply with the sale or use of alcoholic
beverages at the Poway Center for the Performing Arts.
Section 2: Declaration of City Policy. The City Council of
the City of Poway does hereby declare that it shall be the official
policy of the City of Poway that no alcoholic beverages shall be
sold or consumed on the premises on which the Poway Center for the
Performing Arts is situated at any time during which students are
attending a school sponsored activity at the Center or at any time
during which a performance is being given by groups of persons
under the age of twenty-one years.
Section 3: Resolution No. 90-008 is hereby rescinded.

California at a regular meeting thereof this 15th day of May, 1990.
