Res 90-098RESOLUTION NO. 90-098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT (OLD COACH GOLF ESTATES PROJECT - SCH # 90010015) ADEQUATE FOR GENERAL PLAN AMENDMENT 90-0lB CITY OF POWAY: LEAD AGENCY/APPLICANT WHEREAS, the city of Poway received proposed land use and planning applications concerning the proposed Old Coach Golf Estates project involving approximately 708-gross acres of undeveloped land located on the north side of Espola Road and fronting Old Coach Road, and owned by Environmental Developments, Ltd., applicant; and WHEREAS, the Old Coach Golf Estates applications consist of General Plan amendment (GPA 90-0lA) concerning an amendment of the Land Use Element of the Poway General Plan; companion zone change (ZC 90-0lA) concerning an amendment of the City of Poway Zoning Plan; associated planned community specific plan (SP 89-01) containing site-specific regulations for the orderly development and conservation of the project site; and tentative tract map (TTM 89-13) which proposes the subdivision of the project site into 157 lots and open space areas to implement Specific Plan 89-01; and WHEREAS, the project site consists of Assessor's Parcel Numbers, APN's: 273-182-18 and 19; 273-100-10 and 11; 277-010-02, 05, 22, and 23; 277-070-24, 27 through 31; 277-071-01, 02, 08, and 09; and 277-140-01, 06, 23, 24, 26, and 27; and WHEREAS, on March 20, 1990 the city Council considered the report and recommendation of the Poway Transportation Task Force concerning the deletion of Old Coach Road from the General Plan as a future collector arterial connection between Espola Road and Highland Valley Road. The City Council approved the recommendation of the Task Force which concluded that the said connection is not of regional significance and would not result in a positive impact to improve the North Poway transportation and circulation problem. The city Council directed its staff to bring forth a City-initiated General Plan amendment item regarding the subject matter; and WHEREAS, on April 24, 1990 the City Council initiated by resolution the General Plan Amendment 90-01 public hearing including the consideration of the proposed Old Coach Golf Estates project applications, and a separate city-initiated application, General Plan amendment (GPA 90-0lB); and WHEREAS, the proposed Old Coach Golf Estates project does not provide for the extension of Old Coach Road between Espola Road and the project's northerly property line as a continuous public road built to collector arterial standards, and therefore, said project would be consistent with GPA 90-0lB, if approved; and Resolution No. 90-098 Page 2 WHEREAS, GPA 90-01B involves a proposed amendment to the General Plan Circulation Element graphics and text by the deletion of Old Coach Road and an intersecting unnamed road as through- collector arterials, between Espola Road on the south and Highland Valley Road on the north, and more specifically, the proposed deletion of arterial link numbers 42, 43, and 44 from the Circulation Element. In addition, this application proposes an amendment to the text and graphics of the General Plan Land Use Element specifically concerning the Old Coach Special Study Area; and WHEREAS, the draft EIR (SCH #90010015) prepared for the Old Coach Golf Estates Project was completed and circulated for a 45 day public review period (March 6 to April 20, 1990) and the Final EIR which includes the response to public comments and a mitigation monitoring and reporting program is on file in the office of the City of Poway Planning Services Department; and WHEREAS, the potential environmental impacts related to General Plan Amendment 90-0lB were analyzed in the final EIR prepared for the Old Coach Golf Estates Project and said final EIR does not identify any significant adverse environmental impacts that would result from the approval of GPA 90-0lB; and furthermore, the draft EIR public review period did not generate any written public comments that addressed the adequacy of the draft EIR with regard to the subject matter of GPA 90-0lB; and WHEREAS, the Poway City Council, as lead agency and decision- maker, held a properly noticed public hearing on May 15, 1990 to consider the subject final environmental impact report and General Plan Amendment 90-0lB in accordance with the California Government Code and the California Environmental Quality Act (CEQA). NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Poway, as lead agency and decision-maker, the following: The City Council hereby certifies that the subject final environmental impact report has been prepared and completed in compliance with the California Environmental Quality Act and the City of Poway procedures for implementing CEQA. The City Council hereby certifies that the subject final environmental impact report was presented to the City Council who reviewed and considered the information contained in that document including the response to public comments and the mitigation monitoring and reporting program, and considered all testimony received at the public hearing prior to making a decision concerning the final EIR or GPA 90-0lB. Resolution No. 90-098 Page 3 The City Council hereby certifies that the subject environmental document is complete and adequately addresses the potential environmental impacts associated with General Plan Amendment 90-0lB pursuant to CEQA.
