A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
CONFIRMING THE ISSUANCE OF A STATEMENT OF SEWER AVAILABILITY
FROM THE REDEVELOPMENT CATEGORY
AS DESCRIBED IN ORDINANCE 304
FOR AVIANO APARTMENT COMPLEX
(DR 87-06)
WHEREAS, Ordinance 304 adopted on November 14, 1989 established an alloca-
tion plan for sewer capacity and whereas Resolution 89-176 established standards
for issuance of sewer capacity to projects in the Redevelopment Category; and
WHEREAS, the property proposed for development under Development Review
87-06 consists of a 2.45 acre site; more specifically defined as Assessor's
Parcel Numbers 317-232-06, 08, Og and said parcels are currently owned by
Anthony J. Aviano; and
WHEREAS on May 22, 1990, the proposed apartment complex referenced above came
before City Council for determination as to whether the project qualified for
issuance of a Statement of Sewer Availability under the provisions of Resolution
89-176.
WHEREAS, the City Council found that the project provides public benefit,
and addresses the issues, as well as previously approved projects, to warrant
issuance of a Statement of Sewer Availability, in that it will provide 20 per-
cent of the units as assisted housing for a period of 30 years, provide for the
extension of needed infrastructure within the Old Pomerado Road area and provide
a significant new revenue source to the Poway Redevelopment Agency.
NOW, THEREFORE, the City Council hereby approves issuance of a Statement of
Sewer Availability for 49 EDU$ for Development Review 87-06.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 29th day of May, 1990.
