A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
STATING THE CITY OF POWAY'S SUPPORT FOR
THE CONDITIONS OF THE CONSENT DECREE ISSUED BY
THE U.S. DISTRICT COURT BETWEEN THE U.S. EPA,
THE REGIONAL WATER QUALITY CONTROL BOARD AND
THE CITY OF SAN DIEGO REGARDING CERTAIN IMPROVEMENTS TO
THE METRO SEWERAGE SYSTEM REQUIRED UNDER THE CLEAN WATER ACT
WHEREAS, a complaint for a civil action was brought by the
U.S. EPA and the Regional Water Quality Control Board against the
City of San Diego for violations of the Clean Water Act;
WHEREAS, the above mentioned parties have negotiated a Consent
Decree to meet the requirements of the Clean Water Act to avoid the
costs and risks of litigation and to resolve the controversy;
WHEREAS, the City of Poway is a member of the Metropolitan
Sewerage System and the improvements constructed by the City of San
Diego will affect all member agencies;
WHEREAS, the City of Poway is endeavoring to construct the
first satellite water reclamation plant identified in the Consent
Decree with a capacity of 8.0 MGD;
WHEREAS, the City of Poway water reclamation plant will be
constructed on property owned by the City of Poway within the City
of San Diego and much of the reclaimed water will be reused within
the City of San Diego and sludge from the Poway water reclamation
plant will be treated by the City of San Diego and the disposal of
excess reclaimed water will be through properties owned by the City
of San Diego; and
WHEREAS, the City of Poway supports Alternative IV which is
the water reclamation driven alternative for improvements to the
Metropolitan Sewerage System.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Poway that (1) the City of Poway supports the conditions of the
Consent Decree between the U.S. EPA, the Regional Water Quality
Control Board and the City of San Diego as lodged with Judge Rudi
M. Brewster of the the United States District Court and published
in the Federal Register on April 10, 1990, Page 13332 of Volume 55
Resolution No. 90-11Q
Page 2
and (2) that this support be transmitted to the Honorable Judge
Rudi M. Brewster for inclusion in these hearings and (3) that the
Honorable Judge Rudi M. Brewster encourage the City of San Diego to
exercise maximum cooperative effort with the City of Poway during
the planning, design and construction of the proposed Poway water
reclamation facility as an element of the proposal to meet the
provisions of the Clean Water Act.
PASSED, ADOPTED, AND APPROVED by the City Council of the City
of Poway, California at a regular meeting thereof, this 29th day of
