A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING A TRAFFIC MITIGATION FEE FOR
SOUTH POWAY SPECIFIC PLAN AMENDMENTS
THAT CHANGE THE LAND USE DESIGNATION OF PROPERTIES
FROM LIGHT INDUSTRIAL OR INDUSTRIAL PARK
TO SOUTH POWAY COMMERCIAL
WHEREAS, on November 30, 1999, the City Council initiated Specific Plan
Amendment (SPA) 84-01QQ to amend the South Poway Specific Plan Industrial Park
(IP) land use designation to allow more intense uses, such as office buildings, and to
develop appropriate standards; and
WHEREAS, a Traffic Analysis prepared by VRPA Technologies and dated June
26, 2001, reviewed existing and proposed developments inside and surrounding the
South Poway Planned Community, in conjunction with adopted SANDAG 2020 regional
growth and traffic forecasts, to determine the potential unused number of vehicle trips in
Scripps Poway Parkway necessary to accommodate anticipated revisions and
conversion of land uses in the South Poway Planned Community; and
WHEREAS, the traffic analysis for SPA 84-01QQ concluded there are
approximately 17,000 available Average Daily Trips on Scripps Poway Parkway, or 143
acres available for conversion or redistribution; and
WHEREAS, on July 17, 2001, the City Council approved SPA 84-01QQ and
identified 143 acres of property designated Light Industrial that could be converted to
Industrial Park provided such requests be required to mitigate the impact of the land use
intensification through the payment of a traffic mitigation fee; and
WHEREAS, on December 4, 2001, the City Council adopted Resolution No.
01-111 initiating Specific Plan Amendment 84-01DDD to amend the South Poway
Specific Plan to develop a process for the land use designation changes from Light
Industrial to Industrial Park pursuant to SPA 84-01QQ, and adopt a traffic mitigation fee
for those requesting land use changes; and
WHEREAS, on December 17, 2002, the City Council held a duly advertised
public hearing to solicit comments from the public, both pro and con, relative to the
traffic mitigation fee for land use conversions and approved Resolution No. 02-128; and
WHEREAS, land use designation changes from Light Industrial or Industrial Park
to South Poway Commercial also represent an intensification of use necessitating the
payment of a traffic mitigation fee that will be used for the improvements identified in the
Traffic Analysis for SPA 84-01QQ; and

WHEREAS, on March 4, 2003, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to the traffic
mitigation fee for land use conversions from Light Industrial and Industrial Park to South
Poway Commercial.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The City Council finds that the proposed project has been adequately
addressed in, and is within the scope of, the Negative Declarations (ND) approved for
SPA 84-01QQ on July 17, 2001, and SPA 84-01DDD on December 17, 2002. The
project is within the scope of the prior environmental document; therefore, no additional
environmental review or notice is necessary.
Section 2: A land use Traffic Mitigation Fee of $55 per Average Daily Trip (ADT) shall
be applied prior to issuance of a Building Permit for any property within the South
Poway Specific Plan Area that has been granted a land use change to South Poway
Commercial. The trip generation rate (ADT) shall be as specified by City Council
Resolution. A credit shall be applied to the ADT to take into account the ADT of the
underlying zone. For uses other than Office and Professional Uses, the traffic fee shall
be reduced by 25% to account for no significant AM peak hour impact. An additional
50% credit shall be applied to the Traffic Mitigation Fee to account for pass-by trips.
The following formula shall be used:
