A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, DECLARING THE INTENTION TO LEVY AND
COLLECT ASSESSMENTS WITHIN POWAY LANDSCAPE
ASSESSMENT DISTRICT NO. 86-2 FOR FISCAL YEAR 1990-91
WHEREAS, the City Council of the City of Poway desires to levy and collect
assessments within Poway Landscape Maintenance Assessment District 86-2 for the
purpose of maintaining, servicing, and operating public landscape facilities
located within the territory comprised of said district as shown in Exhibit "A"
pursuant to the Landscape and Lighting Act of 1972; and
WHEREAS, the public interest and convenience requires the maintenance,
service and operation of public landscaping, soundwalls, and recreational trails
within said territory.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
The foregoing recitals are true and correct and the City Council so
finds and determines.
Proposed assessments for 1990-91 are as detailed in the Engineer's
Report for Poway Landscape Maintenance District No. 86-2 for fiscal
year 1990-91.
Pursuant to the Streets and Highways Code, a public hearing will be
held on July 17, 1990 in the City Council Chambers at City Hall to
consider the levy and collection of the Proposed assessments.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 12th day of June, 1990.

PURPOSE
The purpose of this report is to set forth the findings and engineering analysis for Poway
Landscape Maintenance Assessment District. No. 86-02 for 1990-1991 fiscal year. The
Assessment District was formed May 20, 1986 as a means of financing the maintenance
of landscape improvements installed in conjunction with new subdivisions in Poway, the
boundary being as shown in Exhibit "A".
FINDINGS
The Landscape and Lighting Act of 1972 permits the establishment of assessment districts
by cities for the purpose of providing for the maintenance of certain public improvements
which include the facilities existing within the subject Assessment District. The 1972 Act
requires that maintenance assessments be levied according to benefit rather than according
to estimated value. Section 22573 provides that:
"Fhe net amount to be assessed upon lands within an
assessment district may be apportioned by any formula or
method which fairly distributes the net amount among all
assessable lots or parcels in proportion to the estimated
benefit to be received by each such lot or parcel from the
improvements."
Based upon the foregoing, it is proposed that the City of Poway generate the necessary
revenue required to maintain the aforementioned landscaping improvements within Poway
Landscape Maintenance Assessment District No. 86-02 for the 1990-1991 fiscal year using
the method provided for in the Landscape and Lighting Act of 1972.
All assessments collected with this District will be spent on maintenance and
administration. There are no new improvements proposed for this fiscal year, therefore
no plans or specifications are a part of this report.

The boundary of the proposed Assessment District is as shown on Exhibit "A". It is
broken into two zones with Sunrise Ranch (TM 4185R), Poway Villas (TM 87-12), and
Garden Road (TM 87-07) comprising Zone A and Sycamore Creek (TM 83-02) comprising
Zone B. The two zones were created because the parcels within Zone A do not
substantially benefit from the landscaping improvements in Zone B and vice-versa. There
is presently a total of 235 units within the District.
The property lines and dimensions of each lot or parcel of land within the Landscaping
Maintenance District are shown in detail on the County of San Diego Assessor's maps, on
file in the County Assessor's Office, 1600 Pacific Highway, Room 103, San Diego, CA
92101.
Exceptions from the assessment of said costs and expenses within the area described are:
all public streets, public avenues, public lanes, public roads, public drives, public courts,
public alleys, ail easements and right-of-way, all public parks, greenbelts and parkways, and
all public school property being used for public school purposes.
NAME
The name of the District is: "Poway Landscape Maintenance Assessment District No.
86-02".

The facilities to be maintained are defined as the landscaping and soundwalls within the
right-of-way and adjacent to Poway Road and Garden Road, the recreational trails,
sidewalks, and greenbelts within the District boundaries.
The estimated value of the existing improvements to be maintained within this
Landscaping Maintenance District is $465,000 and $549,000 for Zones A and B,
respectively.

The District is made up of two zones. Zone A consists of 35 residential units in Sunrise
Ranch TM 4185R), 30 residential units in Poway Villas TM 87-12), and 4 units in Garden
Road TM 87-07)*. Zone B consists of 166 residential units in Sycamore Creek (TM 83-
'02). The assessment for Zones A and B will be calculated by dividing the required "zone
revenue" by the respective number of units (Zone A - 69 units, Zone B -166 units).
