Res 90-137RESOLUTION NO. 90- 137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, APPROVING THE SECOND AMENDMENT TO THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE CITY OF POWAY AND R & R PARTNERS-POWAY AND AUTHORIZING THE EXECUTION THEREOF WHEREAS, the Poway Redevelopment Agency ("Agency") is authorized to conduct redevelopment activities within the Paguay Project Area ("Project Area"), which activities include the acquisition and conveyance of real property for private development; and WHEREAS, the Agency desires to amend a Disposition and Development Agreement (the "DDA") with R & R Partners - Poway, a California general partnership ("Developer") substantially in the form approved hereby and on file in the City Clerk's Office; and WHEREAS, the Agency and the City Council of the City of Poway ("City Council") have conducted a duly noticed joint public hearing regarding the amendment to the DDA in accordance with California Health and Safety Sections 33431 and 33433; and WHEREAS, a copy of the DDA has been made available for public inspection and copying. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: The City Council hereby approves the form of the amendment to the DDA attached hereto. Caldwell Its: President "Developer" -2- Resolution No. 90-137 Page 5 SITE PLAN AGENCY PORTION DEVELOPER PORTION EXHIBIT "A" TO SECOND AMENDMENT TO DISPOSITION AND DEVELOPMENT AGREEMENT RESOLUTION NO. 90-138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ESTABLISHING WATER RATES FOR FISCAL YEAR 1990-1991 WHEREAS, it is necessary to revise the pumping charges for Service Areas; and WHEREAS, it is necessary to revise the capacity charges for various meter sizes; and WHEREAS, it is necessary to establish water rates for fiscal year 1990-1991. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway: 1.
