COVENANT REGARDING REAL PROPERTY ;
Richard Moore and Bhirley Guo, husband and wife as joint tenants, ("OWNE6" hereinafter) �
are the owners of real property commonly known as 16535 .Martincoit Road ("PROPERTY
hereinafter), and more fully described as I
Lot 16 of Green Valley Estates according to Map thereof No. 3455, filed in the County I
Recorder's Office of San Diego County; July 3, 1956. I
In consideration of the approval of Building Permit 812-0320 to construct an 895-square-foot, I
detached garage on the referenced property by the Gity of Poway ("CITY" hereinafter), OWNER
hereby agrees that the detached garage is non-habitable space, will not be rented or leased as a
sepa�ate unit, and no kitchen facilities'will 6e installed. Said detached garage shall not be used for I
commercial purposes except, in accordance with the Home Occupation Permit provision as listed in (
Section 17.28.010 of the Poway Municipal Code.
This CoVenant shall_run.with the land and be binding upon and inure to the benefit of the future �
owne�s, encumbrances, successors, heirs, personal representatives, transfe�ees and assigns of the I
respective parties.
In the event that Building Permits are never obfained to construct the proposed addition at the
request of the OWNERS, the CITY shall expunge this Covenant from the record title of the
PROPERTY.

If either party incurs costs as a result of filing a civil action to enforce the provisions of this '
Covenant; the prevailing party shall be entitled to full reimbursement of all�costs, including reasonable '
attorneys'fees, from the other party. �
