COVENANT REGARDING REALPROPERTY
Phillip Yanni, a married'man as his sole and sepa�ate property ("OWNER" hereinafter),
is the owner of real property commonly known as 14711 Sunrise Canyon Road ("PROPERTY
hereinafter), and more fully described as:
Lot 30 of Poway Tract No. 4185, in the City of Poway, County of San Diego,
State of California, according;to Map thereof No. 11295, filed in�the Office of the
County Recorder of San Diego County, July 24, 1985.
In consideration of the approval of a Building Permit to construct an approximate
1,800-square-foot, detached, non-habitable accessory structure on the above-refe�enced
�property by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that the non-
habi'table accessory structure shail never be converted to living space without first obtaining
approval and appropriate permitsfrom CITY, that the accessory structure shall never be rented
or leased as a separate unit, and no gas line and/or 220 ampere electrical service shall be
installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of therespective parties.
In the event that a Building Pe�mit is never obtained to construct the proposed structure
at the request of the OWNER, the CITY shall expunge this Covenanffrom the record title of the
PROPERTY.
If either party incurs costs as a result of filing a civil action to enforce tFie provisions of
this Coven.ant, the preyailing party'shall be entitled to full reimbursement of all costs, including
reasonable attomeys' fees, from the other party.
