A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE FIRST AMENDMENT TO THE
JOINT EXERCISE OF POWERS AGREEMENT BETWEEN
THE COUNTY OF SAN DIEGO AND THE CITIES
OF DEL MAR, ESCONDIDO, POWAY, SAN DIEGO, AND SOLANA BEACH
CREATING THE SAI~ DIEGUITO RIVER VALLEY REGIONAL
OPEN SPACE PARK JOINT POWERS AUTHORITY
WHEREAS, on May 16, 1990, the city of Poway approved the
Joint Exercise of Power Agreement between the County of San Diego
and the cities of Del Mar, Escondido, Poway, San Diego, and
Solana Beach to preserve and protect the open space greenbelt and
park system in the San Dieguito River Valley; and
WHEREAS, the City of Poway approves the first amendment to
the Joint Powers Agreement which enables the Joint Powers
Authority to contract with member agency employees.
NOW, THEREFORE, the city Council of the City of Poway does
hereby agree to amend the Agreement by adding subparagraphs (i)
through (iii) to Section 9(b) to the Agreement as follows:
1. "i The chief Administrative officer of the County of San
Diego may provide a County employee to perform the services of
Executive Director, subject to the approval and appointment by
the Board. The County employee shall be in the unclassified
service of the County and shall serve at the pleasure of the
chief Administrative officer. The services of the Executive
Director performed by the County employee may be terminated for
convenience by either the Chief Administrative officer or the
Board at any time by either party giving written notice to the
other party of the effective date of termination at least thirty
(30) calendar days before the effective date of such termination.
Such notice also shall be provided to the Executive Director.
The termination of the services of the Executive Director under
this provision shall not affect the employment status of the
County employee with the County of San Diego."
2. "ii The County employee appointed to perform the services
of Executive Director pursuant to (i) above, shall receive
compensation (wages and benefits) for such services in accordance
with the ordinances, resolutions, and rules of the County of San
Diego applicable to the County employee's position in the
unclassified service of the County of San Diego."

3. "iii The Authority shall reimburse the County for the cost
of compensation (wages and benefits) paid to the County employee
for the services of Executive Director preformed by the County
employee."
PASSED, ADOPTED AND APPROVED by the City Council of the City
of Poway, california at a regular meeting thereof this 28th day
of August, 1990.
