Res 90-199RESOLUTION NO. 90-199 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA PURSUANT TO SECTION 65361 OF THE CALIFORNIA GOVERNMENT CODE - APPLICATION REQUEST FOR A ONE-YEAR GENERAL PLAN UPDATE TIME EXTENSION CITY OF POWAY: APPLICANT WHEREAS, the City of Poway incorporated in December of 1980, and in accordance with Government Code Section 65100, the Poway City Council acts as the planning agency or commission for the City; and WHEREAS, on September 20, 1983, the City of Poway City Council adopted the Poway General Plan by Resolution No. 83-066; and WHEREAS, since the initial adoption of the General Plan certain goals, objectives, and programs identified in the plan have been implemented; and WHEREAS, due to changed local conditions and circumstances; the achievement of many of the City's initial General Plan goals, objectives, and policies; and new local/regional planning and environmental issues directly affecting the City of Poway; information and data within the Poway General Plan document has been somewhat out-of-date, and therefore, an update of the Plan is now necessary and appropriate; and WHEREAS, the City of Poway proposes to update its General Plan as necessary to appropriately reflect new conditions, local attitudes,and political realities in accordance with Government Code Section 65358, the State General Plan Guidelines, and the California Environmental Quality Act; and WHEREAS, on August 9, 1990, the Poway City Council approved a work program for the Poway General Plan Update Project; and WHEREAS, the City of Poway, pursuant to Government Code Section 65361, desires to apply to the Director of the State Office of Planning and Research (OPR) for the granting of a General Plan Time Extension of one year in duration for the purpose of promoting the timely and coordinated update of the city's General Plan; and WHEREAS, the City of Poway has prepared this resolution and the related application for general plan time extension, attached hereto as Exhibit A, pursuant to the existing State planning, zoning, and environmental laws referenced above; and WHEREAS, the application form attached as Exhibit A identifies the existing mandatory and optional elements of the Poway General Plan for which this one-year time extension is being requested; and Resolution No. 90-199 Page 2 Wq{EREAS, pursuant to Government Code Section 65361(a) and (b)(1), the City of Poway hereby provides within Exhibit B, attached and incorporated herein, finding (a)(1) and (a)(6) followed by the detailed reasons supporting said findings and explaining why the one-year time extension would promote the timely and coordinated update of the Poway General Plan; and WHEREAS, pursuant to Government Code Section 65261(b)(2), a detailed budget, incorporated herein as Exhibit C, and a schedule for the preparation and adoption of the updated Poway General Plan, incorporated herein as Exhibit D, are attached herewith; and WHEREAS, pursuant to Government Code Section 65361(b) (3), Exhibit E attached and incorporated herein, contains a set of interim policies and procedures which would ensure that the land use decisions made by the City of Poway during the time extension granted will not interfere with, nor be inconsistent with, the general plan proposals being considered or studied; and WHEREAS, the City of Poway acknowledges that the Director of OPR may impose any conditions on extensions of time granted that the Director deems necessary to ensure compliance with the purposes and intent of the Government Code, and that in establishing those conditions, the Director may adopt, or modify and adopt, any of the interim policies and procedures identified within Exhibit E hereof; and WHEREAS, pursuant to Government Code Section 65361(f) of the State Planning and Zoning Law, Section 21080.10(a) of the Public Resources Code (CEQA Statutes), and Section 15266 of the State CEQA Guidelines, an extension of time granted for the preparation and adoption of one or more elements of the general plan is exempt from the CEQA requirements; and the city Council action to defer the 1991 privately-initiated general plan amendment application period until after the adoption of the updated General Plan is categorically exempt from the CEQA requirements pursuant to Section 15061(b)(3) of the Guidelines; and WHEREAS, the City Council held a properly noticed public hearing on October 2, 1990 to consider the subject matter of this resolution and related application in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway does hereby approve the information and documentation contained within the attached Exhibits A through E, incorporates said exhibits by reference as if set forth in full herein, authorizes staff to submit the application package to the Director Resolution No. 90-199 Page 3 of the State Office of Planning and Research for consideration and approval, and said application and this resolution represent the City of Poway's formal request for a one-year time extension to allow the City of Poway to prepare and adopt its General Plan Update Program. EXHIBIT Resolution No. 90-199 Page 6 CITY OF POWAY GENERAL PLaN UPDATE PROGI~AM Pursuant to Government Code Section 65361(a) and (b)(1), the City of Poway City Council makes the below findings (a)(1) and (a)(6), followed by the detailed reasons supporting said findings, and explaining why the Poway General Plan needs to be updated/revised. Finding 1 - Finding 6 - Data required for the general plan shall be provided by another agency and it has not yet been provided. Since the adoption of the Poway General Plan in September, 1983, the City of Poway has diligently pursued a coordinated resolution of land use planning, transportation/circulation, environmental, and other important issues involving governmental agencies at the local, State, and Federal levels. In order to appropriately update the Circulation and other related elements of the Poway General Plan, the city established the Poway Transportation Task Force. Over the past year, the Task Force has directed and coordinated the preparation of numerous technical studies and will develop recommendations for the resolution of local and regional transportation/ circulation issues. Much of the baseline data and projections needed for the Task Force's studies has to be obtained from outside agencies, including the City and County of San Diego, San Diego Association of Governments (SANDAG) , and CalTrans. Land use planning, environmental, and other issues affecting the City of Poway are currently being studied within the San Diego region. Some of the major issues involve natural resources, wastewater treatment, compliance with resource agency requirements, and water conservation. The pending resolution of significant issues has caused a considerable delay in the City of Poway's ability to implement specific general plan goals and to update its General Plan. Because required data and information remains forthcoming from the agencies and jurisdictions, a one-year time extension is needed to prepare a complete and coordinated General Plan update. Other reasons exist that justify the granting of an extension, so that the timely preparation and adoption of an updated general plan is promoted. EXHIBIT B Resolution No. 90-199 Pa ge 7 City of Poway General Plan Update Program Page 2 Since the adoption of the Poway General Plan in 1983, the City has prepared and adopted general plan amendments, special studies, specific plans, and has implemented many of the initial goals and objectives within the General Plan elements. These accomplishments have resulted in the development of current data, statistics, and planning information which will be used to complete a comprehensive update of the local general plan. Other agency actions affecting the City of Poway have also resulted in the development of new information and data to be used for the update. In addition, changes in local conditions and circumstances affecting the natural and man-made environments have caused the need to prepare and complete a coordinated update program. Current information and data affecting the Poway General Plan includes, but is not limited to, emergency planning, hazardous waste regulation, sensitive lands policies, natural resources identification, management and protection, transportation demand management, regional growth forecasting, regional housing needs, flood inundation planning, population census, wastewater treatment, water reclamation, and water conservation. All of the above noted information and data is either partially completed or under study at this time by the City of Poway or other local/regional agencies. This information and data is directly related to the several elements of the Poway General Plan, and therefore, is needed to bring the General Plan into a state of currency. Without this necessary information and data being incorporated, the Poway General Plan will remain somewhat out-of-date. The granting of a one-year time extension, therefore, would promote the timely and coordinated update of the Poway General Plan. REPORT\GPUDB.EXH EXHIBIT B Resolution No. 90-199 Page 8 CITY OF POW&Y GENERAL PLAN UPD&TE PROGRAM Pursuant to Government Code Section 65361(b)(2), the following describes the detailed budget established for the preparation and adoption of the updated Poway General Plan. In accordance with the OPR application requirements, the budget should indicate: The amount of funds allocated to the project; and The allocation of funds among consultant services and local staff. ~mount of Funds A11ooated to the Pro~eot On June 12, 1990, the Poway City Council authorized the appropriation of $150,000 for consultant assistance and environmental review in connection with the Poway General Plan Update Program. These funds will be allocated during the next several months in accordance with the schedule identified in the adopted General Plan Update Work Program (see Exhibit D of this resolution). The appropriated funds are based on estimates made by City staff to cover the cost of professional consultant services. Actual consultant costs would be determined at the time proposals are submitted by the consultant for City review and approval. Project costs associated with the City staff's work effort would be absorbed through budgeted salaries, and overtime, if necessary. It should be noted that the majority of work effort to complete the update program will be accomplished in-house by City staff members of the Planning Services Department. It describes seven major activity sections, some of which will be completed concurrently. BACKG______ROUND The California Government Code requires periodic review and updating of the General Plan. One element, housing, is required to be updated on a fixed time schedule. For jurisdictions within the SANDAG area, the revised Housing Element must be adopted by July 1, 1991. Staff proposes to do the update for the entire plan at one time and anticipates adoption shortly before the July 1, 1991 deadline. DISCUSSION Update Proqram The poWay Comprehensive Plan, which won a national award from the American Planning Association, is a source of pride to the community and major changes to the direction of the document are not anticipated. Rather, the update program is expected to be more technical/fine tuning in nature and will have two major thrusts. The first is a technical update of the base data and a review of goals to separate out those which have been achieved. The incorporation of new State requirements is also part of this technical review. This work is already underway. ACTION: AUG 9 19gO ITF. M Resolution No. 90-199 Page 12 Agenda Report August 9, 1990 Page 2 The second major component of the update is a recheck and refinement of community goals. While no major shifts in direction are expected, a review of the goals and objectives outlined in the General Plan is necessary to ensure that they are still on-target and to allow for further definition to be given in some cases. Public In__n~ Public input is anticipated throughout the process. Section 3, on page 4 of the draft work program, discusses community meetings which are proposed for the period of September through November 1990. Workshops and public hearings on the draft plan would be scheduled during May and June 1991. In addition, written comments would be encouraged throughout the year by means of press releases and Poway Today articles. Staff recommends using the "nominal group" technique for at least some of the early meetings. The "nominal group" is used to assure that all citizen ideas are identified and ranked according to importance. A main strength of the process is that discussions can be focused and no one dominates the discussion which allows everyone to have the opportunity to list his or her concerns without challenge or judgment. This technique has been successfully used in other cities, for example La Mesa, to gather meaningful public input early in the general plan update process. Staff suggests that these early meetings be directed at articulating a "vision statement" for the future of the City. The General Plan elements would then be organized around a structure of: 1) description of current status; 2) description of desired future condition ("vision statement"); and, 3) identification of strategies to achieve the desired goals. Land Use Element Chanqes Very few, if any, changes to land use designations are anticipated as part of the General Plan update program. Because this is an overall update program, staff suggests that it would be inappropriate to consider privately initiated requests for redesignation as a part of this process. In fact, it is recommended that private applications which would normally be accepted before February 28, 1991 be deferred until after adoption of the updated plan so that the attention of Council, staff, and public can be directed to the update program without the distraction of concurrent consideration of privately initiated requests for change. M 3 Resolution No. 90-199 Page 15 SECTION 1: WORK PROGRAM REFINEMENT Task 1.1: Review of Existing General Plan by City Departments Planning Services reviews General Plan Gmdelines and law to identify mandated issue areas for all GP elements, as well as other issue areas relating specificly to Poway..This infom-lation and a description of the technical studies to be prepared by consultants is provided to representatives of other City departments. Planning Services meets with representatives of other City departments to identify existing master plans, programs, projects and efforts already underway which relate to mandated and desired components of the GP elements. Conficts and inconsistencies between present practices of of the various departments and those described in the existing GP elements will be identified. Task 1.2: Compilation of Input Received from City Departments Planning Services compiles input received from all City departments and organizes the input according to the associated GP element(s). This information acts as master listing of existing GP implementation efforts which are already underway and funded. Timeframe: July/August/September 1990 AUG 9 1990 ITF. M 3 Resolution No. 90-199 Page 16 SECTION 2: BACKGROUND DATA DEVELOPMENT I MEA PREPA1LS, TION Task 2.1: Select Consultants for Technical Studies Planning Services develops a methodology for ~lectaon of consultants to prepare technical studies necessary for the GP update. Consultants are selected to prepare technical studies for traffic/circulation, noise, historic/cultural resources, biological resources, and geotechnica~seismic hazards. Task 2.2: Prepare Base Maps Planning Services prepares base maps at both presentation scale (for wall display) and document scale (for inclusion in GP and related documents). An intermediate scale base is also prepared to provide foldout maps (such as the land use policy map) for inclusion in the pockets of the three-ring binders containing the GP and related documents. The base maps include current city pamelization and roadway information, as well as other physical features, such as major drainage courses, water bodies, public facilities, and other relevant features that are relatively constant. Task 2.3: Develop Statistical Baseline Information Planning Services prepares statistical baseline information by mapping existing characteristics of the City which relate to the GP elements. Statistical information prepared describes acres of existing land uses within the City's planning area, numbers of dwelling units, and commercial and industrial intensifies (square footage). The same statistical information is prepared for planned land uses based on the existing GP [and Use Plan. Task 2.4: Prepare Preliminary General Plan Outline/Format Based on the review and input described in Section 1 of the work program, Planning Services prepares a preliminary outline of the GP document describing the elements to be included, the common subsections of each element, tables and figures for each element, and existing implementation programs. This preliminary document outline/mock-up also includes a document format describing the hiearchy of element sections in terms of print font, size and style, as well as graphic style and locations. Task 2.5: Prepare Master Environmental Assessment (MEA) Planning Services prepares a Master Environmental Assessment as described in the CEQA Guidelines. The format of the MEA will be consistent with that of the preliminary General Plan format prepared in Task 2.4. The MEA contains baseline environmental info~iiation describing existing conditions for each environmental impact area contmned m the C~ty Environmental Initial Study Checklist. The MEA becomes the existing environmental setting information for the environmental impact report prepared under Section 5 of the work program. The IV~.A incorporates information included in the consultant prepared technical studies identified in Task 2. Timeframe: July/August/September/October 1990 Resolution No. 90-199 Page 17 SECTION 3: COMMUNITY PARTICIPATION I FORMULATION OF VISION Task 3.1: Community Meetings Conduct five (5) community meetings designed ti> solicit input from cllazens regard g Poway's future. Utilize various techniques, such as the nominative process, questionnaires, and newletter/newspaper articles to generate interest and support for the formulation of a Vision of the Future. Task 3.2: Preparation of Vision Statement Using input received through the community meetings and questionnaires described in Task 3.1, Planning Services prepares a Vision Statement describing community desires for the future of the City. The Vision Statement is reviewed by the City Council, and published through a press release as the official statement providing a basis for the update of the General Plan is authorized. Timeframe: September/October/November 1990 4 AUG 9 1990 ITE, M 3 Resolution No. 90-199 Page 18 SECTION 4: PREPARATION OF DRAFT GENERAL PLAN Task 4.1: Prepare Final Outline of Draft General Plan Planning Services prepares a final outline a~'d~nock-up of the GP document as described in Task 2.4. Task 4.2: Prepare Preliminary Draft General Plan Elements Administrative Preliminary Draft General Plan Elements are prepared by Planning Services following the General Plan Guidelines and law, input from other City Departments received in Section 1 of the work program, and public input received during the community participation stage. Upon completion, the preliminary elements are 'distributed to other City departments for review and comment/corrections, and preliminary elements are also reviewed by any standing citizen committees, such as Parks and Recreation. Preliminary GP Elements are revised by Planning Services. All text, table and graphic changes are made and the Preliminary Draft General Plan is distributed to the City Council. Task 4.3: Review of Preliminary Draft General Plan Elements Preliminary Draft General Plan is reviewed by the City Council through a series of three to four workshops. The purpose of these workshops is to reach consensus on the content of the Final Draft General Plan which ultimately is released for public, review and becomes the subject of the public hearings described in Section 6 of the work program. These workshops are designed to allow staff to provide Councilmembers with explanations of infotmation contained in the elements. In turn, the Councilmembers provide staff with general and specific direction on modifications to the Preliminary Plan. During this stage, all written input received fi~m the public will be provided to the City Council for its review and consideration. Task 4.4: Prepare Final Draft General Plan and Executive Summary Planning Services prepares the Final Draft General Plan based on direction received in Task 4.3, and distributes the Draft Plan as required by state law. This final draft plan becomes the subject of the environmental impact report described in Section 5. An executive Summary of the Final Draft General Plan is prepared for distribution to interested parties. State and local environmental guidelines are followed regarding distribution of the NOP (including the Executive Summary of the Draft General Plan) and a public scoping meeting may be held to determine the final impact areas included for analysis in the EIR. Task 5.2: Prepare Draft EIR A selected environmental consultant prepares the environmental impact report, relying on the Master Environmental Assessment (MEA) prepared as Task 2.5 as a description of the existing environmental setting, and focusing on the discussion of secon~ry environmental impacts resulting from implementation of the General Plan. The EIR also focuses on mitigation measures designed to reduce or avoid negative impacts associated with plan implementation, and includes a mitigation monitoring program as a means of ensuring continuing evaluation of the status of plan implementation. The Draft EIR is then dislributed for public review and comment as required by state and local environmental guidelines. Task 5.3: Prepare Final EIR Responses to comments received during the public review period are prepared by the environmental consultant and a final EIR is published for certification during the public hearing process described in Section 6. These workshops are designed to prepare both City Councilmembers and staff for the upcoming public hearings. The Draft GP and EIR are reviewed, as are all comments received during the public review period. Task 6.2: City Council Public Hearings The City Council conducts public hearings on the Draft General Plan and EIR as a means of receiving public input on both documents. Following the public hearings, the Council formulates any desired modifications to the Plan based upon public input received and their own deliberations. Council then directs staff to incorporate the desired modifications and prepare a final General Plan for adoption. Task 6.3: Adoption of Updated General Plan The City Council certifies the final EIR and adopts the General Plan. Timeframe: July/August 1991 AU~ 9 1~0 ITEM 3 Resolution No. 90-199 Page 22 AUG 9 1990 II'F.M 5 Resolution No. 90-199 Page 23 CITY OF POWAY GENERAL PLaN UPDATE PROGI~J~4 Pursuant to Government Code Section 65361(b) (3), the City of Poway sets forth the following interim policies and companion procedures which will ensure that land use decisions made by the City of Poway during the time extension granted, will not interfere with, nor be inconsistent with, the general plan proposals being considered or studied. Interim Policy 1: During the time extension granted by OPR's director, all land uses proposed in applications for a parcel or subdivision map, general plan amendment/zone change, specific plan or specific plan amendment, use permit, variance, development review or minor development review, or building permit shall be consistent with the Poway General Plan proposals being considered or studied. Procedure 1: The City of Poway Director of Planning Services shall determine that all land uses proposed in the applications noted in Policy 1 above are consistent with the General Plan being considered or studied, and such determination shall be made prior to finding such applications complete. Interim Policy Z: The City of Poway will ensure that while the General Plan Update Program is in process, actions on discretionary land use projects do not preclude planning options which should be properly considered when updating/revising the plan. Procedure 2: Until the updated general plan is adopted, the City of Poway must make the following written findings in approving discretionary land use projects: ao There is a reasonable probability that the proposed land use or action will be consistent with the general plan proposals being considered or studied or which will be studied within a reasonable time. EXHIBIT E Resolution No. 90-199 Page 24 City of Poway General Plan Update Program Page 2 BJ Co Interim Policy 3: Procedure 3: REPORT~UPDATE.exh There is little or no probability of substantial detriment to or interference with the future adopted general plan if the proposed use or action is ultimately inconsistent with the general plan. The proposed use or action complies with all other applicable requirements of State law and local ordinances. On August 9, 1990, the city of Poway City Council adopted a work program for the proposed General Plan Update, and it is important to the City that said work program is carried out in a timely manner. In order to ensure that the attention of the City Council, City staff, and the general public can be directed to the update program without the distraction of concurrent considerations of privately-initiated requests for change, the 1991 privately-initiated General Plan amendment application period is hereby deferred until after adoption of the updated Poway General Plan. In accordance with the City's adopted General Plan amendment schedule, the privately- initiated (general public), pre-general plan amendment application deadline is November 30, 1990, and the formal application deadline is February 28, 1991, with a public hearing to occur on the fourth Tuesday of June, 1991, to consider requests for changes in general plan land use and zoning. Following the adoption of this interim policy, requests for change will be deferred until after the updated General Plan is adopted. EXHIBIT E
