A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE ACQUISITION BY
POWAY REDEVELOPMENT AGENCY OF REAL PROPERTY
IN THE PAGUAY REDEVELOPMENT PROJECT AREA, AND
AUTHORIZING THE EXECUTION OF AN ACQUISITION AGREEMENT
WHEREAS, the Poway Redevelopment Agency (hereinafter referred
to as the "Agency"), under the provisions of the California
Community Redevelopment Law, is engaged in activities necessary for
the execution of the Redevelopment Plan for the Paguay
Redevelopment Project Area (hereinafter referred to as the "Project
Area"); and
WHEREAS, in order to effectuate the provisions of that
Redevelopment Plan, the Agency proposes to acquire certain property
privately owned within the Project Area (hereinafter referred to
as the "Property"), and presently operated as a mobile home park
known as Poway Royal Mobile Estates; and
WHEREAS, there has been submitted to the Agency a written
offer in the form of an Acquisition Agreement (hereinafter' referred
to as the "Agreement") to purchase the Property, for uses in
accordance with the Redevelopment Plan; and
WHEREAS, the city has duly considered all terms and conditions
of the proposed purchase and believes that the acquisition of the
Property pursuant to the subject Agreement is in the best interest
of the City and the health, safety, morals, and welfare of its
residents, and in accord with the public purposes and provisions
of applicable State and local law requirements.
NOW, THEREFORE, the city Council of the City of Poway does
hereby find, determine, order, and resolve as follows:
Section 1. The recitals hereof are true and correct and are
incorporated herein by reference.
Section 2. The acquisition of the Property by the Poway
Redevelopment Agency as described in the Agreement is hereby
approved.
PASSED, APPROVED, and ADOPTED this 16th day of October 1990.
