RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY CONFIRMING THAT CONSTRUCTION OF VALLE
VERDE PARK IS OF BENEFIT TO THE PAGUAY
REDEVELOPMENT PROJECT AREA AND THE IMMEDIATE
NEIGHBORHOOD IN WHICH THE PROJECT IS LOCATED
AND THAT NO OTHER REASONABLE MEANS OF
FINANCING SAID PUBLIC IMPROVEMENT EXISTED.
WHEREAS, by Ordinance No. 117 adopted on December 13, 1983,
the City Council of the City of Poway (the "City") adopted and
approved a Redevelopment Plan (the "Redevelopment Plan") for the
Paguay Redevelopment Project, (the "Project)";
WHEREAS, pursuant to the California Community Redevelopment
Law (Health and Safety Code Section 33000, et seq.) the Poway
Redevelopment Agency (the "Agency") is carrying out the
Redevelopment Plan for the Project in the Redevelopment Project
Area (the "Project Area");
Wq{EREAS, the Redevelopment Plan for the Project Area
authorizes the Agency to pay all or part of the value of the
acquisition and construction of public improvements;
WHEREAS, California Health and Safety Code Section 33445
provides that the Agency may, with the consent of the legislative
body, pay all or part of the value of public buildings, facilities,
structures or other improvements upon a finding that such public
improvements are of benefit to the Project Area or the immediate
neighborhood in which the Project is located and that there is no
other reasonable means of financing such public improvements
available to the community;
WHEREAS, the Agency has contributed toward the cost of
construction of Valle Verde Park (the "Improvement") which is used
by and of benefit to persons residing in the Project Area; and
WHEREAS, no other reasonable means of financing the
Improvement were available in that the cost of the Improvement
exceeded the financial ability of the City to pay, no private
sources of funding were available, and all state and federal grant
alternatives were exhausted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Poway as follows:
Section 1. The City Council hereby finds that the Improvement
is of benefit to the Project Area and the surrounding neighborhood
in which the Project Area is located.

Section 2. The City Council further finds that no other
reasonable means of financing the Improvement was available to the
community.
PASSED, APPROVED AND ADOPTED THIS 27th day of N0vembe~ 1990 at
a regular meeting of the City of Poway by the following vote:
