A RESOLUTION OF THE CITY COUNCIL OF THE CZTY OF POWAY,
STATE OF CALZFORN[A, ORDER[NG THE SUNMARY VACATION
OF RZGHT-OF-WAY PR[V[LEGES AND R[GHTS LOCATED W[THIN
PARCEL 2 OF CITY OF POWAY PARCEL 88-04, NAP THEREOF 15255

WHEREAS, the City Council of the City of Poway desires to summarily vacate
certain public right-of-way privileges and rights in accordance with the proce-
dures provided in Chapter 4, Part 3, Division 9 of the Streets and Highways Code
of the State of California, commencing at Section 8330; and
WHEREAS, the privilege and right to extend drainage structures and excava-
tion and embankment slopes beyond the limits of Poway Road (per Road Survey 944}
where required for construction and maintenance within the attached legal
description titled "Exhibit A" were dedicated to the County of San Diego per
deed recorded October 24, 1944 in Book 1765, Page 267, Official Records in the
Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
This summary vacation is made under the provisions of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
California.

The City Council hereby finds that the herein described public right-
of-way privileges and rights have become obsolete and are no longer
necessary.
3. The City Council hereby declares that the following described right-of-
way privileges and rights are hereby vacated:
See attached legal description titled "Exhibit A."

The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 11thday of~1990.
