AN ORDINANCE OF THE CITY OF POWAY,
CALIFORNIA, AMENDING CHAPTERS 2.08 AND 2.16
OF THE POWAY MUNICIPAL CODE
TO MAKE THE CITY MANAGER THE APPOINTING AUTHORITY
OF THE OFFICES OF CITY CLERK AND CITY TREASURER
WHEREAS, the offices of City Clerk and City Treasurer of the City of Poway are
appointed, and serve at the pleasure of, the Poway City Council; and
WHEREAS, the Poway City Council does hereby desire to change the appointing
authority of the offices of the City Clerk and the City Treasurer to the City Manager; and
WHEREAS, in order to change the appointing authority of the offices of the City
Clerk and City Treasurer it is necessary to amend sections 2.08.070 and 2.08.080 of
Chapter 2.08, and section 2.16.030 of Chapter 2.16, all of Title 2 of the Poway
Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
SECTION 1: Subsection C of section 2.08.070, and subsection B of section
2.08.080 of Chapter 2.08, and subsection C of section 2.16.030 of Chapter 2.16, all of
Title 2 of the Poway Municipal Code, are hereby repealed.
SECTION 2: A new subsection C of section 2.08.070 of Chapter 2.08 of Title 2
of the Poway Municipal Code is hereby added to read as follows:
C. Power of Appointment and Removal. It shall be the duty of the City
Manager to appoint, remove, promote and demote any and all officers and
employees of the City, subject to all applicable personnel ordinances,
rules and regulations except for the City Attorney, who shall serve at the
pleasure of the City Council.
SECTION 3: A new subsection B of section 2.08.080 of Chapter 2.08 of Title 2
of the Poway Municipal Code is hereby added to read as follows:
B. Departmental Cooperation. It shall be the duty of all subordinate
officers and the City Attorney, to assist the City Manager in administering
the affairs of the City efficiently, economically and harmoniously.
SECTION 4: A new subsection C of section 2.16.030 of Chapter 2.16 of Title 2
of the Poway Municipal Code is hereby added to read as follows:
C. The City Manager and City Attorney;
SECTION 5: This Ordinance shall be codified.

EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after its adoption.
CERTIFICATION /PUBLICATION: The City Clerk shall certify the adoption of this
Ordinance and cause it or a summary of it, to be published with the names of the City
Councilmembers voting for and against the same in the Poway News Chieftain, a
newspaper of general circulation in the City of Poway within fifteen (15) days after its
adoption and shall post a certified copy of this Ordinance in the Office of the City Clerk
in accordance with Government Code § 36933.
Introduced and first read at a Regular Meeting of the City Council of the City of
Poway held the 16th day of April 2013, and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 7th day of May 2013.
