A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING GENERAL PLAN AMENDMENTS (GPA) 13 -002,
ADOPTION OF CITY OF POWAY HOUSING ELEMENT UPDATE
(2013 -2020) AND GPA 13 -003 RELATED TEXT AMENDMENT
TO THE COMMUNITY DEVELOPMENT (LAND USE) ELEMENT
WHEREAS, State law requires that cities periodically update the Housing
Element of the General Plan; and
WHEREAS, California Government Code Section 65350, et. seq., describes the
procedures for amending the General Plan; and
WHEREAS, the Draft City of Poway Housing Element Update (2013 -2020) has
been prepared pursuant to Article 10.6, Sections 65580 - 65589.8 of the California
Government Code; and
WHEREAS, the City has held community workshops on the Housing Element
Update on September 25, 2012, and November 13, 2012, to solicit public comment and
has also notified community and special interest groups serving affordable housing and
special needs populations about the public workshops that have been conducted
throughout the process; and
WHEREAS, the Housing Element Update is subject to detailed statutory
requirements and mandatory review by the California Department of Housing and
Community Development (HCD); and
WHEREAS, on February 5, 2013, the City Council held a duly advertised public
meeting and authorized submittal of the Draft City of Poway Housing Element Update
(2013 -2020) to HCD for review and comment; and
WHEREAS, on April 5, 2013, the City received a letter from HCD, which included
written findings stating that the City's draft Housing Element Update addresses all
statutory requirements; and
WHEREAS, text amendments to the Community Development (Land Use)
Element of the General Plan have been prepared that are necessary for consistency
with the City of Poway Housing Element Update (2013- 2020); and
WHEREAS, an Environmental Initial Study (EIS) and draft Negative Declaration
(ND) for the Housing Element Update was circulated for a required 30 -day public review
and comment period beginning on April 12, 2013 and ending on May 13, 2013, in
accordance with California Environmental Quality Act (CEQA) Guidelines Section
15105; and

WHEREAS, on May 21, 2013, the City Council held a duly advertised public
hearing to consider approval of General Plan Amendment (GPA) 13 -002, Adoption of
City of Poway Housing Element Update (2013 -2020) and GPA 13 -003, related text
amendment to the Community Development (Land Use) Element; and
WHEREAS, the City Council has reviewed the Draft Housing Element Update
and Negative Declaration and has considered any evidence presented at the public
meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: As required under the California Environmental Quality Act (CEQA), an
Environmental Initial Study (EIS) was completed for the project. Based upon the
information contained in the EIS and in the public record, the City of Poway has
prepared a Negative Declaration (ND) for the Housing Element Update project. It was
determined that the project will not have any significant adverse impacts on the
environment. Any anticipated impacts were determined to be below a level of
significance and, therefore, do not require any mitigation. The EIS and draft Negative
Declaration was sent to the State Clearinghouse for distribution and review by relevant
state agencies (State Clearinghouse #2013041038) for a required 30 -day public review
and comment period. The City Council hereby approves the Negative Declaration.
Section 2: The City Council hereby adopts the City of Poway Housing Element
Update (2013- 2020), dated April 2013, (GPA 13 -002) as incorporated herein by this
reference, and authorizes the submittal of the document to HCD for certification.
Section 3: The City Council hereby adopts text amendments to the Community
Development (Land Use) Element of the General Plan (Page 5 of the Community
Development (Land Use) Element) (GPA 13 -003) necessary for consistency with the
City of Poway Housing Element Update (2013- 2020).
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, this 21st day of May 2013.
