Ord 750ORDINANCE NO. 750 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, APPROVING SPECIFIC PLAN AMENDMENT 13 -001 TO THE SOUTH POWAY SPECIFIC PLAN TO CHANGE THE LAND USE DESIGNATION FROM LIGHT INDUSTRIAL TO LIGHT INDUSTRIAL - STORAGE ON A 2.62 -ACRE SITE LOCATED AT 13000 KIRKHAM WAY APN: 317 - 270 -11 WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning Development Code) of the Poway Municipal Code provides the requirements for the preparation and adoption of Specific Plans in accordance with Title 7, Division 1, Chapter 3, Article 8 (Section 65450, et seq.) of the California Government Code (Article 8, Specific Plan); and WHEREAS, Ravenwood Towers, Inc., Applicant has submitted a request, Specific Plan Amendment (SPA) 13 -001, to change the Land Use Designation on a previously developed, approximately 2.62 -acre, property located at 13000 Kirkham Way in the Poway Business Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S); and WHEREAS, on May 7, 2013, the City Council held a duly advertised public hearing to receive testimony from the public, both for and against, relative to this application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1: Pursuant to Section 15070 of the California Environmental Quality Act (CEQA), an Environmental Initial Study (EIS) was completed for the project. Based upon the information contained in the EIS and in the public record, the City of Poway has prepared a Negative Declaration (ND) for the project. It is hereby found and determined that the project will not have a significant adverse impact on the environment. Any anticipated project impacts were determined to be at below a level of insignificance and therefore do not require any mitigation. Section 2: The City Council finds that the proposed amendment of the South Poway Specific Plan (SPSP) to change the land use designation on a previously developed, approximately 2.62 -acre, property located at 13000 Kirkham Way in the Poway Business Park, from Light Industrial (LI) to Light Industrial- Storage (LI -S) is consistent with and will still promote the systematic execution of the General Plan, in that future development of the Property will still be subject to applicable General Plan goals, policies and the Light Industrial- Storage land use designation of the SPSP. Section 3: The City Council hereby approves Specific Plan Amendment 13 -001 changing the land use designation from Light Industrial (LI) to Light Industrial- Storage (LI -S) on the property shown in Exhibit A attached to this Ordinance. Ordinance No. 750 Page 2 EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway. Introduced and first read at a regular meeting of the City Council of the City of Poway held this 7th day of May 2013, and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held the 21st day of May 2013.
