COVENANT REGARDING REAL PROPERTY
Herbert H. Perico, an unmarried man, ("OWNER" hereinafter) is the owner of real. property
commonly known as 14831 Espola Road ("PROPERTY hereinafter) and more fully described as:
The Westerly 326.52 feet of the South one-half of the Southwest Quarter of the
. Northwest Quarter of the Southeast QuaRer of Section 6; Township 14 South, Range 1
West, San Bernardino Base and Meridian, in the County' of• San Diego, State of
California according to United States Government Survey. Excepting therefrom the
Southerly 177:48 feet thereof.
In consideration of the approval of a Building Permit to construct a detached, habitable
accessory structure af the above-referenced property 6y the City of Poway {"CITY" hereinafter),
OWNER 'hereCy agrees thaY tiie Yiabitable accessory structure shall never have kitch"em facilities - -
installed and that the accessory structure will not be rented or leased as a separate unit.
This CovenanY shall run with the land and be binding upon and inure to the benefit of future
owners, encurri6�ances, successors, heirs, personal representatives, t�ansferees and assigns of the
respective parties.
In the event that a Building Permit is never obtained to construct the proposed habitable
�eccessory structure at the request'of the OWNER, the .GITY shall expunge this Covenant from the
record title of the PROPERTY.
If either party is required to incur costs to enfo�ce 'the provisions of this Covenant, the
prevailing party shall be entitled to fuil reimbursement of all costs, including reasonable attorneys'
fees, from�the other party. /
