Res 91-042RESOLUTION NO. 91-042 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ESTABLISHING WATER RATES EFFECTIVE MAY 1, 1991 AND RESCINDING RESOLUTION NO. g0-138 WHEREAS, it is necessary to retain the pumping charges for Service Areas; and WHEREAS, it is necessary to retain the capacity charges for various meter sizes; and WHEREAS, it is necessary to establish a block rate water rate structure to respond to the declaration of a water shortage by the San Diego County Water Authority {"SDCWA") and the 20% reduction in the water supply by SDCWA. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway: That the water rate schedule is hereby established as follows for all water purchased by a customer subsequent to May 1, 1991, if the SDCWA water shortage declaration is in effect, until said declaration is rescinded: Basic Water Rate The basic water rate for all classes of service including agriculture and agriculture/domestic shall equal {per unit) Charge Per Unit (100 cubic feet) $1.048 Single Family Dwellings The block rate charges per billing period dwellings shall be calculated as follows: for single family residential First 60 units ................ 61 - 160 units ................. Requests for increased allocations due to special circumstances as described herein shall be submitted to the City Manager in writing pursuant to Section 5 of City of Poway Ordinance No. 336. The City Manager or his designee shall grant or deny such requests within thirty {30) days of their receipt. The decision of the City Manager may be appealed pursuant to Section 7 of City of Poway Ordinance No. 336. Pumping Charges Water customers within the areas specified below shall pay a bimonthly pumping charge for service from a water reservoir: Resolution No. 91-042 Page 3 Service Area Improvement District No. 1 Improvement District No. 4 Orchard A-73, Silver Saddle {portion) Donart Service Area VI Assessment District 79-1 Gregg Reservoir Service Area 1990-1ggl Charge Per Unit (100 cubic feet) $0.200 $0.065 $0.130 $0.150 $o.158 $0.100 $0.100 Capacity Charges All water customers shall pay a bimonthly capacity based upon meter size as follows: Meter Size 5/8 inch 3/4 inch I inch 1½ inch 2 inch 2½ inch 3 inch 4 inch 6 inch 8 inch charge for water service Capacity Charge $10.13 10.33 11.02 14.02 18.71 21.28 23.84 30.57 45.27 81.28 Other Charges Restoration of Service: Delinquency: Returned Check: $20.00 during normal $45.00 for weekends before normal $55.00 for holidays working hours or after or working hours 10 percent of unpaid balance $10.00 That the setting of such charges and rates is categorically exempt from the requirements of CEQA, pursuant to Sections 21080{b){4) and (b){8){1) & (2) and Section 21060.3 of the Public Resources Code, and Title 14 of the Calif- ornia Code of Regulations, Section 1526g{c) and 15273{a){1) & {2) and 15307. 3. That Resolution No. g0-138 is hereby rescinded.
