The Assessment District was formed May 20, 1986 as a means for financing the maintenance of landscape improvements installed in conjunction with new subdivisions in Poway, the boundary being as shown in Exhibit FINDINGS The Landscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of common public improvements. These improvements exist within the subject Assessment District. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The new amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the new amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." It is proposed that the City of Poway generate the necessary revenue required to maintain the aforementioned landscaping improvements within Poway Landscape Maintenance Assessment District No. 86-03 for the 1991-1992 fiscal year using the methods provided for in the Landscape and Lighting Act of 1972. Ail assessments collected within this District will be spent on utilities, maintenance and administration. There are no new improvements for this fiscal year, therefore no plans or specifications are a part of this report. -1- ATTACHMENT A Resolution No. 91-051 Page 4 ENGINEERING ~,N&LYSIS Boundary The boundary of the proposed Assessment District as shown on Exhibit "A" consists of three subdivisions for a total of 134 units. These subdivisions inci~de The Pond (TM 3994), Sycamore Springs/Woodcrest (TTM 88-03), and Carriage Road Townhomes (TTM 89- 06). The property lines and dimensions of each lot or parcel of land within the Landscaping Maintenance District are shown in detail on the County of San Diego Assessor's maps. These maps are on file in the County Assessor's Office, 1600 Pacific Highway, Room 103, ~an Diego, CA 92101. NAME The name of the District is: Assessment District No. 86-03." "Poway Landscape Maintenance F~CILITIES The facilities to be maintained are shown in the Landscape Maintenance District Improvement Plans and include landscaped areas adjacent to Pomerado Road, Beeler Creek, a maintained pond, an area along Poway Road at the intersection of Oak Knoll Road, and an area along Poway Road at the intersection of Carriage Road all within the District boundaries. The estimated value of the existing improvements to be maintained under this Landscaping Maintenance District is $312,000. EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE Landscape maintenance and performance standards and specifications have been developed to assure a continuing level of quality to landscape care of assessment district properties. A general assessment of the present level and quality of landscape maintenance within the District has been recently conducted. The current maintenance levels meet the City landscape maintenance standards. BENEFIT ANALYSIS The District is made up of 30 residential units in Tract 3994, 67 residential units and one commercial unit in Tract 88-03, and 36 residential units* in Tract 89-06. The assessment is calculated on a per unit basis by dividing the required revenue by 134. The City will contribute to meet the expenses of the pond and the park area around the pond. The bid for the Pond improvements will be rebid for fiscal year 1992/93. -2- Resolution No. 91' 051 Page 5 * Carriage Road Townhomes is a 72-unit subdivision with no District maintained facilities located within it. Under present City policy, it is considered to receive a 50% benefit from the District facilities.
