The Assessment District was fo£med January 27, 1987 as a means for financing the maintenance of landscape improvements installed in conjunction with new subdivisions in Poway, the boundary being as shown in Exhibit FINDINGS The Landscape and Lighting Act of 1972 permits the establishment of assessment districts by cities for the purpose of providing for the maintenance of common public improvements. These improvements exist within the subject Assessment District. The 1972 Act requires that maintenance assessments be levied according to benefit rather than according to estimated value. Section 22573 provides that: "The new amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the new amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements." It is proposed that the City of Poway generate the necessary revenue required to maintain the aforementioned landscaping improvements within Poway Landscape Maintenance Assessment District No. 87-01 for the 1991-1992 fiscal year using the methods provided for in the Landscape and Lighting Act of 1972. Ail assessments collected within this District will be spent on utilities, maintenance and administration. There are no new improvements for this fiscal year, therefore no plans or specifications are a part of this report. --1- ATTACHMENT A Resolution No. 91-052 Page 4 ENGINEERING ~ALYS'rS Boundary, The boundary Of the proposed Assessment District is as shown on Exhibit "A" with ~ity Tract 85-04 Units 1 and 2, and TM 87-13 Unit 1 being the present and full extent of the District (480.13 acres). The property lines and dimensions of each lot or parcel of land within the Landscaping Maintenance District are shown in detail on the County of San Diego Assessor's maps. These maps are on file in the County Assessor's Office, 1600 Pacific Hig/lway, Diego, CA 92101. Exceptions from the assessment of said costs and expenses within the area described are: all public street, public avenues, public lanes, public roads, public drives, public courts, public alleys, public rights-of way, all public parks, greenbelts and parkways, and all public property used for public school purposes. NAME The name of the District is: Assessment District No. 87-01." "Poway Landscape Maintenance FACILITIES The facilities to be maintained are shown on the approved landscaping plans for the project and are described as follows: Roadway medians in Pomerado Road, South Poway Parkway, and Community Road, soundwalls, retainir~g walls, and adjacent parkways along Pomerado Road, South Poway Parkway, and Community Road, detention basins, staging area, parks and retention basins. The landscaping plans are incorporated in the report by reference. The estimated value of the existing improvements to be maintained within this landscaping maintenance district is $12,200,000. EXISTING CONDITIONS OF LANDSCAPE MAINTENANCE Landscape maintenance and performance standards and specifications have been developed to assure a continuing level of quality to landscape care of assessment district properties. A general assessment of the present level and quality of landscape maintenance within the District has been recently conducted. The current maintenance levels meet the City landscape maintenance standards. -2- Resolution No. 91-052 Page 5 BENEFIT ANALYSIS The District is made up of 143.87 acres in Units 1 of TM 85-04, 187.41 acres in Unit 2 of TM 85-04, and 148.85 acres in Unit 1 of TM 87-13. The assessment will be calculated on a per-acre basis by dividing the required revenue by 480.13.
