Barikers Hill Property, LLC; ("OWNEft�' 'hereinafter) is 4he owner of real property commonly
known as 14936 Gavan Vista Road ("PROPERTY hereinafter) and more fully described as:
' Parcel 4 of Parcel Map No. T0836 as filed In the Recorders Office of County of San
Diego, State of Califomia on December 24, 1980.
In consideration of the approval of a Building Permit,for construction, pursuant to Minor
Deyelopment Review Application 12-042, on tlie above-referenced:property of a detached, habitable
accessory structure by the City of Poway ("CITY" hereinafter); OWNER hereby agrees that the
habitable accessory slructure shall neyer have kitchen facilities installed and that the accessory
___ _ st�ucture will not.tie:rented or'leased_as:a separate unit.
This Covenant shall run with the land and be binding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event .that a Building Permit is never obtained to construct the proposed habitable
accessory structure at the request of the OWNER, tfie `CITY shall expunge this Covenant'from the
record title of the PROPERTY.
If either party is Yequired to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including.reasonable attorneys'
fees, from the other party.
