COVENANT REGARDING REAL PROPERTY
Green Tech LLC, a Califomia LLC ("OWNER" hereinafter), is the owner of real property
located on Del Ponienfe Road ("PROPERTY hereinafter), and more fully described as:
Lot 6 of City of Poway Tract Map 89-09, in the City of Poway, County of San Diego, State of
Califomia,. according to Map thereof No. 14091, filed in the Office of the County Recorder of
San Diego County, Decem6er 5, 2000.
In consideration of the approval of a Minor Development Review Appiication 12-007 and
Building Permit B13-1307, to construct a detached 485-square-foot guest house with a 299-square-
foot garage on the referenced property by the City of Poway ("CITY" hereioafte�), OWNER hereby
agrees that the guest house shall never be rented or leased as a separate unit, and no complete
kitchen facilities shall be installed; and the garage shall not be conveRed to habitable space without
approval of the appropriate permits.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representafives, transferees and assigns of the
respective parties.
Ih.the event'ttiat a_ Building Permit is never obtained to construct ihe proposed guest house at
the request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY. - -_ _ _ _
If either party incurs costs as a result of filing a civil action to enforce the pFovisions of this
Covenant, the�prevailing party',sliall be entitled to full �eimLiursement of all costs, including reasonable
attomeys' fees, from thejother party.
