Res 91-083RESOLUTION NO. 91~083 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING AN AMENDMENT TO THE SOUTH POWAY SPECIFIC PLAN (SPA 84-01L) WHEREAS, the City Council periodically finds it necessary to amend the South Poway Specific Plan; and WHEREAS, on July 30, 1985 the City Council adopted a resolution approving the South Poway Planned Community (SPPC) Development Plan, and said plan has been prepared and adopted as a Specific Plan, and provides for the systematic implementation of the Poway General Plan; and WHEREAS, Ordinance 239 established Specific Plan regulations including implementation procedures; and WHEREAS, the City Council has initiated South Poway Specific Plan Amendment 84-01 L involving allowing industrial air space condominiums within the LI (Light Industrial) and IP (Industrial Park) land use designations; and WHEREAS, on July 30, 1991, the City Council of the City of Poway held a properly noticed public hearing in accordance with the California Government Code and the California Environmental Quality Act to consider this request; and WHEREAS, the City Council considered the previously certified environmental impact report (EIR) for the South Poway Planned Community in 1985 and the Subsequent EIR of 1988 to be adequate for this request. NOW, THEREFORE, be it resolved that the City Council does hereby amend the text of the South Poway Specific Plan (Volume II, Development Standards): The underlined text below is hereby added to the tentative map procedures: Section III. Tentative Map Procedures Tentative maps will be processed according to existing City procedures and ordinances with the exception that slope analysis will not be required in those areas where developed property is not subject to slope density requirements. It is anticipated that the grading and standards contained herein will adequately address slope stabilization and erosion control. Tentative and final maps for industrial condominium projects and non-residential planned unit developments will be processed,according to existing City procedures, the State Subdivision Map Act, the provisions of the State Civil Code, and the provisions of the State Business and Professions Code. Resolution No. 91-083 Page 2 Tentative and final maps for air space industrial condominiums are allowed pursuant to Section 66427.2 of the Subdivision Map Act within the LI (Light Industrial) and IP (Industrial Park) land use designations. Covenants and agreements for reciprocal use of driveways, parking, walkways, fire hydrants, water lines and other facilities are subject to review by the City Attorney, Planning Services, Engineerinq Services and Safety Services Departments unless waived pursuant to Section 66428.
