A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
REDUCING WATER RATES ESTABLISHED
FOR FISCAL YEAR 1991-1992
AND RESCINDING RESOLUTION NO. 91-073
WHEREAS, the City Council adopted water rates for flscal year 1ggl-1992 on
June 25, 1991; and
WHEREAS, the City Council desires to reduce the water commodity and capacity
rates retroactive to all water billed after July 1, 1991; and
WHEREAS, it is necessary to retain the pumping charges for Service Areas;
and
WHEREAS, it is necessary to continue the block rate structure to respond to
the declaration of a water shortage by the San Diego County Water Authority
(SDCWA) and the 20% reduction in water supply by SDCWA.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway:
Section 1. That the water rate schedule is hereby revised as follows for all
water billed after July 1, 1991 if the SDCWA water shortage declaration is in
effect, until said declaration is rescinded:
Basic Water Rate
Charge Per Unit

The basic water rate for all classes of service
including agricultural and agricultural-domestic
shall equal (per unit):

Single Family Dwellings
The block rate charges per billing period for
single family residential dwelling shall be
calculated as follows:
Up to 60 units
61 - 160 units
Above 160 units

Construction Water
The block rate charges per billing period for
construction water use billed under hydrants or
industrial park construction shall be calculated
as follows:
80% of total units used in billing period
Next 10% of total units used in billing period
Last 10% of total units used in billing period

All Other Service Types
The block rate structure per billing period for all other service types shall be
based upon a baseline amount of water determined by a percentage of the water
consumption for the same period of tlme in 1989-90 as specified below:

The block rate charges for all other service types shall be calculated as
follows:
Up to 80% of 1989 use
Between 81% and 90% of 1989 use
Above 90% of 1989/90 use

Multiple Family Dwellings
Multiple family dwelling complexes served by more than one meter may elect to
have the water consumption on all of the meters aggregated for billing purposes
and application of block rate charges. A one-time charge of $2.00 per dwelling
unit will be assessed to cover programming costs.
Special Circumstances
No service in base year
1989 for all service
types except residential
and construction water use
Use 1990 service or average use of comparable
property.
Requests for increased allocations due to special circumstances as described
herein shall be submitted to the City Manager in writing pursuant to Section 5
of City of Poway Ordinance No. 336. The City Manager or his designee shall
grant or deny such requests within thirty {30) days of their receipt. The
decision of the City Manager may be appealed pursuant to Section 7 of City of
Poway Ordinance No. 336.

Section 2. That the setting of such charges and rates is categorically exempt
from the requirements of CEQA, pursuant to Sections 21080{b)(4) and {b){8){1) &
{2} and Section 21060.3 of the Public Resources Code, and Title 14 of the
California Code of Regulations, Section 1526g{c) and 15273{a}{1) & {2) and
15307.
Section 3. That Resolution No. 91-073 is hereby rescinded.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 13th day of August, 1991.
