Res 91-108RESOLUTION NO. 91-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA REDUCING WATER RATES ESTABLISHED FOR FISCAL YEAR lg91-1992 AND RESCINDING RESOLUTION NO. 91-093 WHEREAS, the City Council adopted water rates for fiscal year 1991-1992 on June 25, 1991; and WHEREAS, the City Council desires to revise the tiered billing structure for all residential water customers; and WHEREAS, customer who charged Tier paid; and WHEREAS, and the City Council desires to credit back to any residential has paid Tier 2 or Tier 3 rates, but who would not have been 2 or Tier 3 rates under the revised structure, any excess amounts it is necessary to retain the pumping charges for Service Areas; WHEREAS, the City Council desires to suspend the block rate structure for the September/October 1991 billing cycle for all water customers; and WHEREAS, if the City maintains a 20% or greater conservation level, the Council desires to continue suspension of the block rate structure until such time as the City drops below the 20% conservation level, or the San Diego County Water Authority rescinds the declaration of the water shortage. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway: Section 1. That the water rate schedule is hereby revised as follows for all water billed after July 1, 1991 if the SDCWA water shortage declaration is in effect, until said declaration is rescinded: Basic Water Rate Charge Per Unit (100 cubic feet) The basic water rate for all classes of service including agricultural and agricultural-domestic shall equal {per unit): Single Family Dwellings The block rate charges shall be based upon comparison of water consumption for the same period of time in 1989-90 beginning with May 1, 1989. A one-time charge of $2.00 per dwelling unit will be assessed to cover programming costs. Special Circumstances No service in base year 1989 for all service types except construction water use Use 1990 service or average use of comparable property. Requests for increased allocations due to special circumstances as described herein shall be submitted to the City Manager in writing pursuant to Section 5 of City of Poway Ordinance No. 336. The City Manager or his designee shall grant or deny such requests within thirty {30) days of their receipt. The decision of the City Manager may be appealed pursuant to Section 7 of City of Poway Ordinance No. 336. Pumping Charges Water customers within the areas specified below shall charge for service from a water reservoir: Service Area Improvement District No. 1 Improvement District No. 4 Orchard A-73, Silver Saddle {portion) Donart Service Area VI Assessment District 79-1 Gregg Hydro Pump Station Community Pump Station Welton pay a bimonthly pumping 1991-1992 Charge Per Unit (100 cubic feet} $0.156 $0.065 $0.105 $0.150 $o.158 $o.ioo $0.100 $0.156 $0.156 Resolution No. 91-108 Page 4 Capacity Charges All water customers shall pay a bimonthly capacity charge for water service based upon meter size as follows: Meter Size Capacity Charge 5/8 inch $11.78 3/4 inch 11.98 1 inch 12.67 1½ inch 15.67 2 inch 20.36 2½ inch 22.93 3 inch 25.49 4 inch 32.22 6 inch 46.47 8 inch 82.93 Other Charges Restoration of Service: Delinquency: Returned Check: $20.00 during normal working hours $45.00 for weekends or after or before normal working hours $55.00 for holidays 10 percent of unpaid balance $10.00 Section 2. That the water bills for all residential water customers under the block rate structure will be recalculated under the revised structure in this resolution and any credits due will be applied to the November/December 1991 cycle. Section 3. That the block rate structure for all water customers will be sus- pended for the September/October 1991 billing cycle and all water for all service types will be billed at Tier 1. If the City maintains a 20% or greater conservation level for that time, suspension of the block rate structure will continue. If the City does not achieve a 20% or greater conservation level in any month, the City will institute the block rate structure beginning with the next two-month billing cycle. Implementation during the first billing cycle will be done on a pro-rated basis. The block rate billing structure will then remain in effect until the 20% mandatory water conservation requirement is lifted by the San Diego County Water Authority. Section 4. That the setting of such charges and rates is categorically exempt from the requirements of CEQA, pursuant to Sections 21080{b}{4) and {b){8}(1) & {2) and Section 21060.3 of the Public Resources Code, and Title 14 of the California Code of Regulations, Section 15269{c) and 15273{a){1} & {2} and 15307. Section 5. Resolultion No. 91-!08 Page 5 That Resolution No. 91-093 is hereby rescinded.
