A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
DENYING WITHOUT PREJUDICE ZONE CHANGE ZC 91-01A
WHEREAS, the City Council of the City of Poway recognizes that the need
may arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq, of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, the City initiated an application requesting redesignation of
approximately 50.4 undeveloped gross acres of property owned by the Nature
Conservency and located in the southeast quadrant of the intersection of Metate
Lane and Montauk Street APN 317-222-10, 317-300-01 through 29; and
WHEREAS, the application requests a change in zoning from Open Space (OS)
to Open Space - Resource Management (OS-RM); and
WHEREAS, a properly noticed public hearing was conducted in accordance with
Section 65853, et seq., of the California Government Code and the California
Environmental Quality Act to consider this land use and zone reclassification;
and
WHEREAS, the City Council has considered the information presented in the
staff report and the on-going negotiations with the property owner and hereby
determines that the proposed application is premature and the existing zoning
designation is appropriate.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny,
without prejudice, Zone Change 91-01A.
