A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF POWAY, CALIFORNIA, ESTABLISHING CRITERIA FOR
AWARDING CONTRACTS TO LICENSED AND UNLICENSED CONTRACTORS
WHEREAS, existing State law provides that it is a
misdemeanor for any person without a contractors license to
submit a bid to a public agency when attempting to conduct
business or act in the capacity of a contractor; and
WHEREAS, the October 9, 1991 enactment of Assembly Bill 800
amends Business and Professions Code Sections 7028.7 and 7028.15
requiring public agencies to verify that contractors are properly
licensed at the time a contractor submits a bid; and
WHEREAS, Business and Professions Code Section 7028.7
authorizes the Registrar of Contractors to issue citations
containing civil penalties ranging from $200 to $4,500 to
responsible officers or public agency employees who knowingly
award contracts or issue purchase orders to unlicensed
contractors; and
WHEREAS, Business and Professions Code Section 7028.15
establishes that unlicensed contractors are to be considered
nonresponsive and that all contracts and purchase orders issued
to an unlicensed contractor are void.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Poway as follows:
Section 1. It shall be the policy of the City of Poway to
require licensed contractors for every City project which
requires a contractor and require city employees to verify the
status of a contractor's license when a bid is received by the
City and before award of the contract by the City Council to that
bidder. The invitation to bid shall clearly identify the
license(s) required by the bidder(s).
