A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY
DETERMINING THAT THE ACQUISITION OF A SITE AND
CONSTRUCTION OF IMPROVEMENTS FOR A PUBLIC LIBP~ARY
IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency (the "Agency") desires to acquire
a site and undertake the construction of improvements for a public library to be
located in the vicinity of the northwest corner of the intersection of Poway and
Midland Roads (the "Project"); and
WHEREAS, the proposed Project is within the Paguay Redevelopment Project
area and the site acquisition and construction of the aforesaid improvements is
necessary for the execution of the Project under the provisions of the California
Community Redevelopment Law (Health and Safety Code, Section 33000 et seq.), and
pursuant to the Redevelopment Plan for the project, which Redevelopment Plan was
adopted on December 13, 1983 by Ordinance No. 117 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety Code requires
the Agency to determine the issue of benefit to the Paguay Redevelopment Project
prior to construction of the public improvements and that no other reasonable
means of financing are available.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1. It is determined that the site acquisition and construction of
a public library is of benefit to the Paguay Redevelopment Project Area in
the following manner:
A)
The Paguay Redevelopment Plan as adopted by Ordinance No. 117 on
December 13, 1983 specifically provided for the construction of a
public library.
B)
The City of Poway Library Master Plan as approved by the City
Council in June 1990 analyzed the existing library facilities, found
them to be inadequate, and recommended both interim and long term
improvements. The plan indicated a community build-out need of
31,600 square feet for the library as compared to the 4,800 square
feet now available. The proposed Project will provide approximately
23,000 square feet.
c)
A community survey conducted in conjunction with the Library Master
Plan study indicated that 61 percent of all residents surveyed from
both within and without the project area used the library and
indicated interest in improved services.

Section 2. It is determined that no other reasonable means of financing
the library improvements are available to the community. General Fund
monies are not available for this project. The Library Master Plan
approved in June 1990 reviewed General Obligation Bonds, Revenue Bonds,
Certificates of Participation, Tax Allocation Bonds, Special Assessment
Districts, Mello-Roos Financing, Development Fees, and grants through the
California Library Construction and Renovation Bond Act. Having assessed
each of the above and having unsuccessfully applied for grant funds, the
only reasonable financing is through the Redevelopment Agency.
Section 3. The City Clerk shall certify to the adoption of this
resolution.
