A RESOLUTION OF THE POWAY CITY COUNCIL
APPROVING THE LEASE BY THE POWAY REDEVELOPMENT AGENCY
OF REAL PROPERTY IN THE PAGUAY REDEVELOPMENT PROJECT AREA,
MAKING FINDINGS OF ENVIRONMENTAL IMPACT AND
AND AUTHORIZING THE EXECUTION OF A
LEASE AND MANAGEMENT AGREEMENT
WHEREAS, the Poway Redevelopment Agency (hereinafter referred
to as the "Agency") under the provision of the California Community
Redevelopment Law, is engaged in activities necessary for the
execution of the Redevelopment Plan for the Paguay Redevelopment
Project Area (hereinafter referred to as the "Project Area"); and
WHEREAS, in order to effectuate the provision of that
Redevelopment Plan, the Agency proposes to lease certain property
owned by the Agency within the Project Area (hereinafter referred
to as the "Site"); and
WHEREAS, the City of Poway has agreed to lease and manage the
site in the form of a Lease and Management Agreement (hereinafter
referred to as the "Agreement") at a price less than fair market
value of the land and the improvements for use as a public library
in accordance with the Redevelopment Plan for a public library; and
WHEREAS, the proposed Agreement contains all the provisions,
terms and conditions, includes all obligations required by State
and local laws, and ensures use of the Site in accordance with the
purposes and objectives of the Redevelopment Plan and the Project;
and
WHEREAS, the Agency and the City Council of the City of Poway
held a joint public hearing on the proposed lease of the Site
pursuant to published notice as required by law; and
WHEREAS, the Agency has duly considered all terms and
conditions of the proposed lease and believes that the use of the
Site pursuant to the subject Agreement is in the best interests of
the City and health, safety, morals and welfare of its residents,
and in accord with the public purposes and provisions of applicable
State and local law requirements.
NOW THEREFORE, the City Council of the city of Poway does
hereby find, determine, order and resolve as follows:

Section 1. The recitals hereof are true and correct and are
incorporated herein by reference.
Section 2. The lease of the real property by the Redevelopment
Agency to the city of Poway by the Agency as described in the
Agreement is hereby approved.
