Ord 122 ORDINANCE NO. 122 AN ORDINANCE OF THE CITY OF P(IWAY, CALTRORNIA ESTABLISHING DESIGNATED TRUCK ROUTES AND A MAXIMU~ GROSS WEIGHT LTMIT WHEREAS, there is no existing designation of truck routes and maxima gross weight limits within the City of Poway; and WHEREAS, there is a nc~ to establish designated truck routes for vehicles with rated gross weight exceeding twenty thousand (20,000) pounds in order to protect the public interest, health, welfare and safety of the citizens of Pow-ay. THE CITY COUNCIL OF THE CITY OF Pf~AY DOES ORDAIN AS FOLLOWS: Section 1. Pursuant to the provisions of Section 35701 of the Vehicle Code, no person, cor- poration, or any other organization shall use or operate any c~mercial vehicle or any vehicle excc~ing twenty thousand (20,000) pounds rated gross vehicle weight on or over any street, road or public right-of-way within the City except the following streets which are designated as truck routes: 1. Poway RDad between westerly City limit and State Highway 67; 2. Pcmerado Road between north City limit and south City limit; 3. Espola Road between westerly City limit and Pow-ay RDad; 4. Oa~,~unity Road between Twin Peaks Road and Poway Road; 5. Twin Peaks Road between Pcmerado Road and Espola Road; 6. Camino del Norte between westerly City limit and Pomerado Road. Section 2. The provisions of this section are not applicable with respect to any vehicle which is subject to the provisions of Sections 1031 through 1036, inclusive of the Public Utilities Code. Section 3. This ordinance shall not be effective until the appropriate signs are erected indicating those streets which are affected by the provisions of this ordinance. Ordinance No. 122 Page 2 Section 4. This ordinance shall not prohibit any ccmm~_rcial vehicles cc~ing frcm an unrestricted street having ingress or egress by direct route to and from a restricted street when necessary for the purpose of raking pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted strut for which a building permit has been previously obtained. Section 5. This ordinance shall not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in construction, installation, or repair of any public utility. Section 6. This ordinance sb~ll take effect and be in force thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a na~spaper of general circulation published in the City of Poway.
