Res 92-082Resolution No. 92-082 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY STATE OF CALIFORNIA, ORDERING THE VACATION OF A DRAINAGE EASEMENT WITHIN LOT 58 OF CITY OF POWAY TRACT NO. 81-01, MAP THEREOF 11037 RECORDED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY ON SEPTEMBER 14, 1984 (Vacation 92-02) WHEREAS, the City Council of the City of Poway desires to summarily vacate a certain public easement in accordance with the procedures provided in Chapter 4, Part 3, Division g of the Streets and Highways Code of the State of California, commencing at Section 8330; and WHEREAS, a drainage easement within the attached legal description titled "Exhibit A" was dedicated to the City of Poway on Map 11037 recorded September 14, 1984 in the office of the County Recorder. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: This summary vacation is made under the provisions of Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of California. 2. The City Council hereby finds that the herein described drainage easement is unnecessary due to development of the area. 3. The City Council hereby declares that the following described drainage easement is vacated: See attached legal description titled "Exhibit A" The City Clerk of the City of Poway is hereby directed to cause a certified copy of this resolution to be recorded in the office of the County Recorder of San Diego in accordance with the provisions of Section 8336 of the Streets and Highways Code. Thence North 47 degrees 09 minutes 04 seconds East along the centerline of said drainage easement 29.41 feet to the True Point of Beg~-n~-g. Said point being on the centerline of a 10 foot wide drainage easement. The centerline description of said 10 foot wide drainage easement is as follows: Thence continuing North 47 degrees 09 minutes 04 seconds East along the centerline of said drainage easement, 40.31 feet. Thence North 67 degrees 09 minutes 04 seconds East, 83.00 feet. Thence North 40 degrees 53 minutes 02 seconds East, 46.17 feet to the Point of Term~natiun of said 10 foot drainage easement vacation. Thence continuing North 40 degrees 53 minutes 02 seconds East, 61.83 feet along the centerline of said 10 foot drainage easement 61.83 feet to a point intersection with the Southerly right of way of Solera Way. Said point being on the arc of a curve Southwesterly and having a radius of 374.00 feet. A radial line to said point bears North 41 degrees 04 minutes 26 seconds East. Thence Southeasterly along said right of way through a central angle of 02 degrees 58 minutes 20 seconds, an arc distance of 19.40 feet. Thence continu- ing along said right of way tangent to said curve, South 45 degrees 57 minutes 14 seconds East, 15.51 feet. Thence North 44 degrees 02 minutes 46 seconds East, 5.00 feet to the beginning of a curve concave Southwesterly and having a radius of 20.00 feet. A radial line to said point bears North 44 degrees 02 minutes 46 seconds East. Thence Southeasterly along said right of way through a central angle of 73 degrees 33 minutes 18 seconds, an arc distance of 25.68 feet to a point on the westerly right of way line of Tannin Drive. Said point being the beginning of a curve concave Easterly and having a radius of 821.00 feet. A radial line to said point bears North 62 degrees 23 minutes 56 seconds West. Thence Southerly along said right of way through a central angle of 08 degrees 24 minutes 20 seconds, an arc distance of 120.44 feet. Thence tangent to said curve South 19 degrees 11 minutes 44 seconds West along said right of way, 7.31 feet.
