COVENANT REGARDING REAL PROPERTY
Marci Poll Christensen, an unmarried woman, ("OWNER" he�einafter)` is the owner of real
property commonly known as 13537 Willow Run Road ("PROPERTY hereinafter) and more fully
described as:
That certain parcel.of land designated and delineated as.Parcel 31 on Yecord of survey
no. 4253, filed April 10, 1957 as File No. 53408, in the Office of the County Recorder of ,
San Diego County, being a portion of the Southeast Quarter of Section 25.
In consideration of the approval of a Building Permit to construct a detached, unhabitable
accessory structure at the above-referenced property by the City of Poway ("CITY" hereinafter),
OWNER hereby agrees that tfie accessory structure will nof be•rented or leased as a separate unit
and no further improvements will 6e constructed in the accessory structure until obtaining a building
permit.
This Covenant shall run with the land and be binding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that a Building Permit is never obtained to construct the p�oposed habitable
accessory structure at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY.
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, incliading reasonable attorneys'
fees, from the other party.
