COVENANT REGARDING REAL PROPERTY
New Pointe Investment 24; LLC, ("OWNER" hereinafter) is the owner of real property
commonly known as 14480 Cheyenne Trail ("PROPERTY hereinafter) and more fully described as:
Lot 25 of City of Poway Tract 89-13R the Heritage Phase 1, Unit 1, in the City of Poway,
County of San Diego, State of California, according to Map ttie[eof No. 13708, filed In the
Recorders Office of County of San Diego, State of California on December 17, 1998.
In consideration of the approval by the City of Poway ("CITY" hereinafter) of a Building Permit
for construction pursuant to Minor Development Review Application 12-054 on the above-referenced
property, which will have a detached, habitable accessory structure, OWNER hereby agrees that the
habitable accessory structure shall never have kitchen facilities installed and that the habitable
accessory structure will not be rented or leased as a separate unit.
This Covenant shall run with the land and be 6inding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transfe�ees and assigns of the
respective parties.
In the event that a Building' Pe�mit is never obtained to construct the proposed habitable
accessory structure at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY.
If either party is required' to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party.
