A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING AN AMENDMENT TO THE SOUTH
POWAY SPECIFIC PLAN (SPA 84-01S)
WHEREAS, the City Council periodically finds it necessary to
amend the South Poway Specific Plan; and
WHEREAS, on July 30, 1985 the City Council adopted a
resolution approving the South Poway Planned Community (SPPC)
Development Plan, and said plan has been prepared and adopted as
a Specific Plan, and provides for the systematic implementation
of the Poway General Plan; and
WHEREAS, Ordinance No. 239 established Specific Plan
regulations including implementation procedures; and
WHEREAS, on July 26, 1988, the City Council adopted a
resolution revising the amendment process for the South Poway
Planned Community Development Plan to utilize the Specific Plan
Amendment procedures for the City of Poway (Chapter 17.47 Zoning
Development Code); and
WHEREAS, in accordance with Section 17.47.020.B, the
proposed amendment to the Specific Plan was requested and
initiated by Resolution No. 91-122 adopted October 29, 1991 by
the City Council; and
WHEREAS, the City proposes to reduce the minimum lot size
for one-half acre to one-third acre for the following existing
lots: Lots 102 and 104 of Map No. 12572, Parcel 2 of Parcel Map
No. 15625 and Parcel 1 of Parcel Map No. 15221; and
WHEREAS, the City of Poway held a properly noticed public
hearing in accordance with the California Government Code and the
California Environmental Quality Act to consider the amendment;
and
WHEREAS, the City Council finds that the proposed reduction
in required lot size will clarify the legal status of the four
previously created parcels; and
WHEREAS, the City Council finds that the previously adopted
Negative Declaration with mitigation measures based on the
Environmental Initial Study, with addendum, adequately addresses
the environmental issues associated with the amendment.
NOW, THEREFORE, be it resolved that the City Council does
hereby amend the South Poway Specific Plan as follows:

Standards Volume 2, shall be revised as follows:
a. Minimum Parcel Size
one-half (1/2) acre

The City Council may grant exceptions to lot size
requirements to approve parcels as small as one-
third acre. Parcels less than 1/2 acre in size
should include the following provisions:
Zero lot line on common wall construction for
buildings on adjacent properties.
Reciprocal access agreement for common driveways
where series of one-third acre lots are created.
Review of covenants, conveyances, and restrictions
(CC&Rs) by the City Attorney, Directors of
Planning, Engineering, and Safety Services.

A minimum parcel size of one-third acre is
approved for lots within Tentative Map 91-07 and
91-08, for Lots 102 and 104 of City of Poway Tract
85-04 Unit 2, except for Parcel 2 of Parcel Map
No. 15625 at 0.32 acres and Parcel 1 of Parcel Map
No. 15221.
APPROVED and ADOPTED by the City Council of the City of
Poway, State of California, this 16th da of June, 1992.
