A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, DETERMINING THAT THE IMPROVEMENT
OF GARDEN ROAD TO ITS ULTIMATE WIDTH TO BE OF
BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency has undertaken the
improvement of Garden Road to ultimate width (5242); and
WHEREAS, the proposed project is within the Paguay
Redevelopment Project and pursuant to the Redevelopment Plan for
the project, which Redevelopment Plan was adopted on December 13,
1983 by Ordinance No. 117 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety
Code requires the Agency to determine the issue of benefit to the
Paguay Redevelopment Project prior to expenditure of funds and that
no other reasonable means of financing are available; and
WHEREAS, the improvement of Garden Road provides safe
pedestrian access for elementary school children between school and
home; and
WHEREAS, public infrastructure improvements on Garden Road, in
this case new concrete curb, gutter and sidewalk and the
undergrounding of overhead utility lines provide a stimulus for
private investment in nearby properties which contain low and
moderate income housing; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Poway as follows:
The Council finds that improvement of Garden Road to
its ultimate width is of benefit in that (1) it provides
improved pedestrian access for elementary school
children walking to and from school and (2) it is a
public investment in infrastructure which can stimulate
private improvements in adjacent neighboring property.
The Council determines that pursuant to Health and
Safety Code 33445, (1) the improvement of Garden Road is
of benefit to the Project area and neighborhood in
which such property is situated; and (2) no other
reasonable means of financing the project is available
to the City of Poway.
