RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
CALIFORNIA DETERMINING THAT CONSTRUCTION OF
CURBS AND TURN LANE IMPROVEMENTS ON TWIN PEAKS ROAD
TO BE OF BENEFIT TO THE PAGUAY REDEVELOPMENT AGENCY
WHEREAS, the Poway Redevelopment Agency will undertake the
construction of curbs and dual turn lanes on Twin Peaks Road east
of State Route 56 (5267); and
WHEREAS, the proposed project is within the Paguay
Redevelopment Project and pursuant to the Redevelopment Plan for
the project, which Redevelopment Plan was adopted on December 13,
1983 by Ordinance No. 117 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety
Code requires the Agency to determine the issue of benefit to the
Paguay Redevelopment Project prior to expenditure of funds and that
no other reasonable means of financing are available; and
WHEREAS, construction of the curb and installation of the dual
turn lanes will enhance pedestrian safety and improve driving
safety in the area surrounding Twin Peaks Plaza; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Poway as follows:
The Council finds that the curb and turn lane
improvements on Twin Peaks Road are of benefit in that
they provide for improved pedestrian and vehicular
movement and reduce the potential for accidents at the
intersection of Twin Peaks and State Highway 56.
The Council determines that pursuant to Health and Safety
Code 33445, (1) the improvements are of benefit to the
project area and neighborhood in which such property is
situated; and (2) no other reasonable means of financing
the project is available to the City of Poway.
