Res 92-118RESOLUTION NO. 92-118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, DETERMINING THAT THE CONSTRUCTION OF THE TEMPLE STREET STORM DRAIN TO BE OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT WHEREAS, the Poway Redevelopment Agency will undertake the construction of the Temple Street storm drain from Brighton Avenue to Rattlesnake Creek (5411); and WHEREAS, the proposed project is within the Paguay Redevelopment Project and pursuant to the Redevelopment Plan for the project, which Redevelopment Plan was adopted on December 13, 1983 by Ordinance No. 117 of the City Council; and WHEREAS, Section 33445 of the California Health and Safety Code requires the Agency to determine the issue of benefit to the Paguay Redevelopment Project prior to expenditure of funds and that no other reasonable means of financing are available; and WHEREAS, the extension of the storm drain system will provide for safer streets and neighborhoods within the central Old Poway area during heavy storm periods; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway as follows: The Council finds that construction of the storm drain extension is of benefit in that (1) it provides for improved drainage in the central Poway area during peak storm periods, and 2) provides investment in pulblic infrastructure which may stimulate private property investment in the immediate neighborhood. The Council determines that pursuant to Health and Safety Code 33445, (1) the construction of the storm drain is of benefit to the Project area and neighborhood in which such property is situated; and (2) no other reasonable means of financing the project is available to the City of Poway.
