RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, DETERMINING THAT THE DESIGN OF
ROADWAY AND STORM DRAIN IMPROVEMENTS ON ESPOLA ROAD
TO BE OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency will undertake the
design of road and storm drain improvements on Espola Road north
1400 feet from the Twin Peaks intersection and the design of a
storm drain along the east side of the roadway (5257); and
WHEREAS, the proposed project is within the Paguay
Redevelopment Project and pursuant to the Redevelopment Plan for
the project, which Redevelopment Plan was adopted on December 13,
1983 by Ordinance No. 117 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety
Code requires the Agency to determine the issue of benefit to the
Paguay Redevelopment Project prior to expenditure of funds and that
no other reasonable means of financing are available; and
WHEREAS, design of the roadway and storm drain improvements
will enhance pedestrian safety and improve vehicular access to
adjoining residential neighborhoods, and reduce the potential for
flooding at the Twin Peaks/ Espola Road intersection; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Poway as follows:
The Council finds that the design of roadway and storm
drain improvements on Espola Road are of benefit in that
(1) they provide for improved pedestrian movement and
vehicular access to and from adjacent neighborhoods, and
(2) reduce the potential for flooding at the intersection
of Twin Peaks and Espola Road.
The Council determines that pursuant to Health and
Safety Code 33445, (1) the improvements are of benefit to
the project area and neighborhood in which such property
is situated; and (2) no other reasonable means of
financing the project is available to the City of Poway.
