A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
DETERMINING THAT PURCHASE OF ASSESSOR PARCEL NUMBERS
321-100-18 AND 321-260-11 TO BE OF BENEFIT TO THE
PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency will undertake the
construction of the South Poway Expressway (5261) and the
construction of Rattlesnake Creek Detention Basin (5410); and
WHEREAS, the proposed projects are within the Paguay
Redevelopment Project and pursuant to the Redevelopment Plan for
the project, which Redevelopment Plan was adopted on December 13,
1983 by Ordinance No. 117 of the City Council; and
WHEREAS, Section 33445 of the California Health and Safety
Code requires the Agency to determine the issue of benefit to the
Paguay Redevelopment Project prior to expenditure of funds and
that no other reasonable means of financing are available; and
WHEREAS, construction of the proposed South Poway Expressway
will impact coastal sage habitat and riparian oak forest; and
WHEREAS, the City of Poway requires the aforesaid impacted
habitat to be replaced; and
WHEREAS, this property fulfills the requirements for
replacement mitigation land; and
WHEREAS, purchase of this property is essential to provide a
site for construction of the detention basin.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Poway as follows:
the Council finds that purchase of the property is of
benefit in that 1) it provides necessary mitigation
land for the improvements of South Poway Expressway;
and 2), it provides a site for construction of the
Rattlesnake Creek Detention Basin.
the Council determines that pursuant to Health and
Safety Code 33445, 1) the purchase of the property is
of benefit to the Project area and neighborhood in
which such property is situated; and 2) no other
reasonable means of financing the purchase is available
to the City of Poway.

PASSED, ADOPTED, AND APPROVED by the City Council of the
City of Poway at a regular meeting thereof this 23rd day of June,
1992.
