A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
APPROVING THE FORM OF A SUBLEASE/RENTAL AGREEMENT TO
BE USED WHEN SUBLEASING UNITS OF THE HALEY PARK ESTATES
WHEREAS, the Poway Redevelopment Agency (the "Agency") and Poway Land, Inc.
{the "Developer"} entered into a certain Owner Participation Agreement, dated 1
19- (the "OPA") and amendment dated 19- for the development of a certain portion
of the Paguay Redevelopment Project Area {the "Project Area"}; and
WHEREAS, the Developer and the Agency are proceeding to perform their
respective obligations pursuant to the OPA; and
WHEREAS, the Poway Redevelopment Agency is ready to sublease the newly
constructed mobilehome units pursuant to the OPA and the Agency wishes to adopt
a form Sublease/Rental Agreement (the "Agreement") in the form set forth in the
attached Exhibit "A" when subleasing units of Haley Park Estates; and
WHEREAS, the public hearing to approve the form sublease has been noticed
for the prior two consecutive weeks and the form Sublease Agreement and the 33433
report have been on file with the City Clerk's office pursuant to the
requirements of Health and Safety Code Section 33433;
BE IT RESOLVED, FOUND AND DETERMINED by the City Council of the City of
Poway as follows:
Section 1. The City Council hereby approves the form Sublease/Rental
Agreement as attached hereto as Exhibit "A" and authorizes the City Manager and
Mayor to execute any documents needed to carry out the terms of the Subleases.
