A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
APPROVING TEMPORARY USE PERMIT 13-026
WHEREAS, Temporary Use Permit 13-026; City of Poway, Applicant, requests
approval to relocate the weekly Poway Farmers Market onto Midland Road between
Adrian Street and Edgemoor Street, and extend the hours of operation of the Market to
new hours of 8:00 a.m. to 1:00 p.m.; and
WHEREAS, on July 16, 2013, the City Council considered the above-referenced
item.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council finds that Temporary Use Permit 13-026 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the 2013 CEQA Guidelines, as the event is temporary in nature and
will have no permanent effect on the environment.
Section 2: The additional appropriations for Temporary Use Permit 13-026 listed in
attached Exhibit "A" are to be made.
Section 3: The proposed use is in accordance with the purposes and standards of
Section 17.26.030 of the Poway Municipal Code.
Section 4: The City Council hereby approves Temporary Use Permit 13-026 to
relocate the weekly Poway Farmers Market onto Midland Road between Adrian Street
and Edgemoor. Street, and extend the hours of operation of the Market to new hours of
8:00 a.m. to 1:00 p.m. subject to the following conditions:
A. The event and related offsite parking shall be conducted as shown on the
approved site plan and application on file in the Development Services
Department.
B. The Farmers Market will operate during the hours of 8:00 a.m. to 1:00 p.m.
Closure of the segment of Midland Road between Adrian Street and Edgemoor
Street will occur between 6:00 a.m. and 2:00 p.m. on Saturdays from September
28, 2013, through September 28, 2014, to accommodate setup and tear down
before and after Market operating hours.
C. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.

D. The site shall be used in accordance with the approved site plan on file in the
Development Services Department, Planning Division, except as otherwise
provided herein:
1. The Applicant shall comply with the Poway Sign Ordinance. TUP 13-026
hereby approves the signage shown on the Event Signs for the Farmers
Market, which includes two 3' x 12' Farmers Market banner signs, six
"Special Event Ahead" directional signs, and four "Road Closed" signs.
These signs will be temporary and displayed only during the time of the
market events.
Additionally, one sign shall be placed in the right-of-way along the east
side of Midland Road at the southerly driveway entrance of the Old Poway
Village commercial center for northbound traffic on Midland Road and a
second sign placed in the right-of-way along the west side of Midland
Road near the Old Poway Park Train Barn for southbound traffic on
Midland Road warning motorist that Midland Road will be closed every
Saturday for the Farmers Market. The signs shall be placed one week
before the first Saturday that the section of Midland Road is temporarily
closed for the market event and remain in place until the fourth Saturday
that Midland Road is temporarily closed for the market event. The sign
copy shall read as follows: "Midland Road Closed Every Saturday 6:00
a.m. —2:00 p.m. "Farmers Market"
E. The following requirements shall be addressed to the satisfaction of the
Engineering Division:
1. Regular street sweeping shall continue to be completed on Midland Road.
Presently, the street sweeping occurs every other Thursday. When the
street sweeping contract is up for renewal, the Applicant shall arrange for the
regular street sweeping of Midland Road to occur on every Monday.
2. A minimum of 12 trash receptacles shall be provided within the market area.
3. The Applicant shall comply with the Best Management Practices for Storm
Water Protection as outlined in the application for TUP 13-026 under the
section on Storm Water Regulations for the Farmers Market on file in the
Development Services Department, Planning Division.
4. A minimum 10-foot-wide pedestrian crossing shall be maintained behind and
adjacent to the road closure barricades placed across Midland Road at the
intersection with Temple Road.
F. The following requirements shall be addressed to the satisfaction of the Fire
Marshal:
1. Do not block emergency vehicle access to any building, street, fire
hydrant, fire sprinkler system connection, or the event site.

2. Do not block any doors or means of egress from buildings.
3. Obtain a permit from the Fire Department for any tent that exceeds 200
square feet or any canopy that exceeds 400 square feet. No cooking is
permitted in or under a tent/canopy.
4. Secure any compressed gas cylinders from falling over.
5. Provide a fire extinguisher with a minimum rating of 2A10BC at any booth
where the cooking of food is done.
6. Provide a Class K fire extinguisher where grease producing cooking is
done.
G. At the conclusion of each weekly Farmers Market event, the applicant shall
comply with the following:
1. Public streets and off-street parking areas associated with the Farmers
Market event shall be cleared of debris, litter, temporary signs, and all
other evidence of the event.
Section 5: This approval shall become null and void on September 28, 2014.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 16th day of July 2013.
