Res 92-168RESOLUTION NO. 92-168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY FINDING THAT THE PROPOSED AMENDMENT TO THE PAGUAY REDEVELOPMENT PLAN WILL NOT DISPLACE A SUBSTANTIAL NUMBER OF LOW AND MODERATE INCOME FAMILIES AND DECLARING THERE IS NO NEED TO FORM A PROJECT AREA COMMITTEE WHEREAS, The City Council of the City of Poway did adopt the Paguay Redevelopment Plan {the "Plan") for the Paguay Redevelopment Project Area on December 13, 1983; WHEREAS, the Poway Redevelopment Agency (the "Agency") has initiated proceedings to amend the Paguay Redevelopment Plan; WHEREAS, the proposed Amendment will not change the Project Area boundaries; WHEREAS, the textual changes that constitute the proposed Amendment to the Paguay Redevelopment Plan do not change land use controls within the Project Area and alter the status of the existing residents located within the existing Project Area boundaries or change the restriction prohibiting the use of eminent domain in residential areas; and WHEREAS, Section 33385 (f) of the California Community Redevelopment Law (the "Law") requires that if a redevelopment project will not displace a substantial number of low and moderate income families the Agency shall either call upon residents and existing community organizations to form a project area committee or the Agency shall consult with, and obtain the advice of, residents and community organizations as provided for project area committees in Section 33386 of the Law; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: The City Council hereby finds and determines that the proposed Amendment to the Paguay Redevelopment Plan will not result in the displacement of a substantial number of low and moderate income families. SECTION 2: The City Council hereby finds, determines and declares that there is no need to form a project area committee in connection with the proposed Amendment to the Paguay Redevelopment Plan. SECTION 3: The City Council hereby directs staff to utilize the existing Redevelopment and Housing Advisory Committee to inform and gain advice on the proposed Amendment.
